HomeMy WebLinkAboutHousing & Redevelopment Authority Resolution 25E.- 10 HOUSING AND REDE'MOPMENT AUTHORITY CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the Housing and Redevelopm:-nt Authority of Plymouth, Minnesota was held on the 26th day of June , 19 78. The following members were present: rha i r nan Cnanth rnmmi acinnare Rakka and Nai 1 e Commissioner Neils introduced the following Resolution and moved its adoption: HRA Resolution No. 25 AUTHORIZING ANNUAL CONTRIBUTIONS CONTRACT FOR SECTION 8 RENT ASSISTANCE PROGRAM WHEREAS, the Housing and Redevelopmep* Authority of the City of Plymouth has made application for 25 units of Sectiboi 8 Existing Housiig for the pur- pose of providing low and moderate income persons with suitable housing, and WHEREAS,. the HUD Local Area Office has approved the Plymouth Housing and Redevelopment ,Authority Section 8 application, and WHEREAS, the HUD Local Area Office has submitted to the Plymouth NRA the Annual Contributions Contract for the Plymouth HRA's commissioners' acceptance, NOW, THEREFORE, BE IT RESOLVED BY THE HOUSING AND REDEVELOPMENT AUTHORITY OF THE. CITY OF PLYMOUTH, MINNESOTA that the chairman of the HRA of the City of Plymouth, Minnesota be authorized to execute the Annual Contributions Contract as attached hereto. The motion for the adoption of the foregoing Resolution was duly seconded by Commissioner Bakke , and upon vote being taken thereon, the following voted in favor thereof7 Chairman Spaeth. The PHA shall not enter into any Contract or take any other action which will result in a claim for an Annual Contribution in respect to the Pro- gram in excess of the amount stated in this paragraph (c). d) PHA Oblittation. In order to cavy out the Program, the PITA is authorized to (a) enter into Housing Assistance Payments Contracts, (b) malts housing assistance payments on behalf of Families, and (c) take all other necessary actions all -in accordance with the forms, conditions and requirements prescribed or approved by the Government; Provided, however, that neither the PHA nor this Governmtnt shall assume any obligation beyond that provided in Contracts in the form approved by the Government. 1.3 Term of ACC. Any renewal of the Contract and Lease term, and any continuation of tenancy beyond cite term, sinall in no Lase cxlerid beyond cite term of this ACC. 1.4 Annual Contrsbution. a) Notwithstanding any other provisions of this ACC (other than paragraph (c) of this Section) or any provisions of any other contract between the Government and the PHA, the Government shall not be obligated to make any Annual Contribution or any other payment with respect to any Fiscal Year in excess of the amount stated in Section 1.1 rc). b) Subject to the maximum dollar 6111112tion in paragraph (a) of this Section, the Government shall pay ror each Fiscal Year an Annual Contribution to the PHA in respect to tilt Program in an amount equal to the sum of tate following (subject to reduction by ilia amount ref any Program Receipts other than Annual Con- tributions, which Receipts shall be available for Program Exprnditures): 1) The amount of housing assistancu payments payahle during the Fiscal Year (see Section 1.5) by the PHA pursuant to the Contract, as authorized in Section 1.2. A 2) The allowance. in the amount approved by the Government, for preliminary costs of ad- ministration. 3) Tate allowance, in the amount approved by ilia Government. for regular costs of administra- tion, including costs of Govemment-required audits of Owners and the PHA. c) (1) An ACC eserve account will be established and maintained by the government, as a spuafi- cally identified and segregated account. in an amount as determined by the Government consistent with it: responsibilities tinder .section 8fc)(6) of ilia Act. The PHA shall comply ,villa all provisions of its HUD -approved equal opportunity housing pan. 1.8 Expeditious Carrying Out of Pmitmm. The PHA shall proceed expeditiously with the Program.
