We will examine the financial statements of the Plymouth Housing and Redevelopment. Authority for the year ended December 31. 1978 in conformity with generally accepted accounting principles applied on a consistent basis and also in conformity with .federal audit requirements. We will perform such tests of the accounting system, accounting data and accounting records as are required and necessary in the circum- stances. We will review the system of internal control as is required by generally accepted. accounting principles andauditing standards. We anticipate the results of our examination will al :)w us to express an unqualified opinion on the fairness of the presentation. of the financial statements in conformity with generally accepted accounting principles. The procedures employed by us are not designed to detect the existence of fraud. However, any findings that indicate a possibility that fraud exists will be reported to the Authority. Our rates charged for service will be the same rates charged the City of Plymouth. We anticipate charges not to exceed $850.00 for the year ended December 31, 1978. in the event less hours are required, the charge would be less. We would an",cipate charges not to exceed 1.800.00 for a fiscal year audit. The charge for the fiscal audit is larger than the charge for the annual duditt for the following reasons: Mr. James Willis Jane 25, 1.978 Page 2 1. The additional time period involved would require audit of a larger volume (1 z years) of accounting materials, and. 2.. The Federal government (H. U. D..) has specific audit requirements in. regard to compliance with their regulations. Union City Mission has been approached by the Northwest Human Services and West Hennepin Human Services Planning Council to operate a shelter for battered women. In accordance with the preparation these groups have done, we will submit an application to the State of Minnesota. The State is scheduled to make its awards by August 30, 1979. If our proposal is funded we will seek the appropriate special use permits from: the City of Plymouth. The specific inquiry I have of you is related to bringing the residential. portionof the program up to code. We have an excellent site and a building which in many ways is uniquely suited for the program. In that the building has not been used for several years, it would require renovation to meet the program needs and the building code. Is this project eligible to apply for Community development funds? If so, what is the process and time lines? I am willing to meet with you and the relevant Boards and Agencies at your convenience. Six units, selected sequencially, will be inspected, beginning with account #2 and continuing with every ninth file itntil six units have been inspected. 2. Please arrange the units in a logical travel and time order and inforn the tenant that a HUD Official will be coming to inspeco the unit. Please inform the tenant that the focus of the inspection will be on the structure, not on housekeeping. The tenant will be asked a few brief questions. 3. If the tenant cannot be home for the inspection, please make arrangements for someone to meet and admit the inspectors. 4. It will be necessary that a staff person from your agency acccmpany the inspector on all visits to units. 5. Attac.bed is an inspection form for each unit to be inspected. A recent study pf the Section 8 Existing Housing. program by the Office: of the Inspector General revealed a number of suspected cases of fraud and abuse. These violations are currently being investigated and could lead to a termination of assistance to tenants involved in fraud or abuse, the termination of participation in the Section 8 program of owners and managers involved,. and possible denial of future participation in HUD programs. It is the policy of the Area Office to refer all suspected cases of fraud and abuse to the Regional Inspector General for Investigation. Attached are three letters on fraud. PHA's are required to distribute these letters as follows: 1. The Tenant Letter.; Attachment #1, should be sent to all tenants participating in the Section 8 Existing Program and all PHA employees. 2.. The Owner/!tanager Letter, Attachment l/2, should be sent to all owners and managers of units with tenants receiving subsidy under the Section 8 Program. A copy of this letter should also be provided to all PHA employees. 3. The PHA.Employee Letter should be sent to all PHA employees. You will not8 that both tate owner and tenant letters (Attachments I. and 11) discuss extra ("side") payments. You are reminded that the only extra payments which are legal are those for extra amenities which are not included in the rent for any other units in the building and are not Included in the rent in other comparable apartment/houses. This could but does not necessarily include membership in a swimming pool or use of parking facilities. All extra payments must be approved by the PITA. The HUD Office of Inspector General (IG) and their employees, owners/inanagers and tenants participating in the Section 8 Existing Housing Program.. In order that the Department may provide Section -8 housing assistance to as many needy families as possible, all participants in this HUD sponsored program must properly utilize Goverment funds and follow Departmental policy requirements. Incidences of fraud, willful misrepresentation, or intent to deceive with regard. to the Section 8 Existing Housing Program are criminal acts. If you are suspected to committing any fraudulent actions, we are required to refer the matter to the proper authority for appropriate action. This could lead to an investigation of the allegation and could result in your being accused of a. Federal crime. You could also be terminated from participation in the program. Some examples of fraud involving owner/managers identified by the IG's investi- gation inciide: 1. Requiring extra ("side") payments in excess of the family's share of the rent. As you know, any payment in excess of the rent must receive prior approval by us. 2. Collecting assistance payments for units not occupied by Section 8 tenants. 3. Bribing PHA employees to certi`y substandard units as standard. We urge you to report any violations of the Section 8 Existing. Housing Program. Riese violations should: be reported immediately rather than to continue in non- compliance with program requirements. If you know of any violations or fraud committed by other persons, including PHA employees, tenants or other owners, please contact Milt Dale at 559-2800. In addition, we are writing to tenants who are receiving. Section 8 Housing Assistance Payments requesting their assistance in preventing abuse of the program.
