SUBJECT: Section 265 Program (Scattered Single Family Housing)
On July 25th, John Spaeth and myself attended a meeting in the HUD Area Office
with Chuck Cornea, the Section 265 (formerly Section 235) Program specialist
regarding a Section 265 Progra:;t in Plymouth. Incidentially outside of the name
change,(or number change if you prefer) Section 265 is the same as Section 235.
We asked questions of fir. Ccr%nea and two other HUD people what we can do and what
we can"t do using the Section ?S" Program. We did determine that the only housing
that will gi.alify for the '12F5" ^ogram is single family detac"ed ned construrt-oor
homes. No doubles or patio hog -,-'i And no existing new constr;U^IAZd-ffe houses that
have bee4, a,a i 1 t but not yet lived iia) are allowed. The matter of windfall profits
was also discussed and. it was drm dor l that a l ett;:r should be mailed to the HUD
Area Office explaining exactly how our Housing and iiedevelop;rent Authority proposed
to handle this. Then the attorneys with HUD can determine whether it wouldba
legal. Churr:. Cornea did express the opinion that our plan had irnrit, ie a repay-
ment agreerr. itv.:;antr.-tcr with thu ho,^e auyer. Your chaiman, John Spaeth, explaincd
the Repayment Agreeir9nt conditions as follows.
1. The Pl)T-Iouth Housing and Authorit-' provide $5,000' :r rth
of improvements on the hov;e to be built. These improvements would
take the form of an attached garage, an asphalt drivenay and landscaping
materials, ie trees, shrubs nod sodding.
2. Thi: home bu-//!r sign a Repay- nt Agreement with the Ply; outh Hai.'sing and
Redevelopa.-nt Authority that he will stay in the hovs. for at least five
years or if not, at the time of resale he will pay the Plymoath (lousing
and Redevelopment Aut*oority a stipulated percentage of the $5,000 based
on his length of st.-y, ie as follows:
Less then one year stay he repays HRA 100% of amount, ie $5,000
One year stay he repays HRA 86% of amount, ie. $4,000
Two year stay he repays HRA 60% of amount, ie $3,000
Three year stay he repays HRA 40% of amount,: ie $2,000
Four year stay he repays HRA 209 of amount, ie $1,000

It appears that our next step(after we find out if our Repayr ent Agreement is
legal) is to find builders that wish to participate in the prograr:±. The next
step is to find a willing mortga1e lender who is familar with the Sv!rtion 265
Program. He subm.it3 the applications to FHA.
In regards to finding builders, we should Pave a check -list of conditions thit
the blousing and Redeveloprt4ent Authority requir;:3 prior to construction. Followingisstaff's proposal as to what some of these it. -ors should be:

A letter to local builders could be mailed out explaining briefly the program and
tOeir responsibilities. After a certain number of builders have indicated their
interest, the Housing and Redeveloptirc:nt Authority Ce,!^rissioners would review plans
and specs (and inspect previously constructed homes) and make a selection. After
that point, the builder would be responsible to find a mortgant: lender, build the
home and find a buyer. The buyer would then sign the Repayment Agreement with the
Plymouth Housing and Redeveloptent Authority.
Staff will be sending this proposed procedure on to Me city's attorney to determine
if we would be operating in a legal and orderly fashion.

Housing and Redevelopment Authority Budget for 1979
Staff has pr%pared a budget for the operation of the Plymouth Housing and Redevelop-
ment Authority for 1979. This budget is subject to the Housing and Redevelopment
Authority's review and the City Council's approval. The basic programs currently
operating under the Housing and Redevelopment Authority are:
1. Section 8 Rent Assistance Program
a. 47 units now under contract
b. 25 units proposed
2. Home Improvement. Grant Programs
a. MHFA sponsored program _

Scme of the operating expenses for these progiams are "built in" as with th-S Sectio:r 8
Rant Assistance Program, the Horne Improvcrrcnt Grant Programs and the Section 235
Program.. As ex-7Tbased on a federally devised formula, ie number'of unit months
x HUD-approved.2 bedroom Fair Parket Rent x Allowable percent (0.035)=Administrative
fee. For the fiscal year ONly 1, 1978 - June 30, 1979, the Plyrrcuth Housing and

for the year 1978, the City did approve a levy amount of 0.09 mill for the
administration of Housing, and Redevelopment Authority activities. This':wount
was $13,505. A smaller levy amount could suffice, ie s the difference between
estimated eXpenditures $25,.170 and the 1979 request of $32,221 is $7,051.
In regards to salaries, staff has estir a—ted a 6%, increase in regular salaries
and a 23% increo,--a in terporaey sdlaries. The- high percentage increase in
temporary salaries would be to allow a wore qualified somewhat higher paid
person to work part -tine in the Housing and Redevelopment Authority office. At
present, the high school student, while very helpful, may need to be assisted
by a more experienced person who can assume a greater degree of responsibility
in either the Section. 8 Program or the Howe Improvement Grant Program. It should
be toted that as of this date approximately $900 has been expended for temporaryhelpwithatotalof $3,900 allocated'in the 1978 budget for this item. It
may be that the $4,800 could be trimmed slightly as a $4/hour person at 20 hours/
week would equal $4,160.
From this year and last year's experience, I have discovered that the cost of
office supplies can be reduced sona:wha t. Staff suggests a review of this proposed
budget and action at the upcoming weeting in August to meet the budget calendar
deadlines.

On the above dates,: I was "entertdined" by the HUD areA staff at a Section 8
Workshop held at the Curti.s•Hotel in Minneapolis. It was a very informative
and helpful workshop as we were involved with "experts" -it varioa-- levels of
goverrr-iont and private industry. As an attachment, I have included the workshop
agenda and some of the hand-out literature that was proviwed. In all 130 people
were involved.
For rLy part it was interesting to talk with other Housing and Redevelupmnrt Autha-
rity people from various parts of the state,. ie Fryrgus .Falls, Red 4aing, South.

Authority's operate sone.:'',:t differently from ours as regards the Section 8 Prn-
gram with the City of East Grand Forks Housing and Redevelopment Authority's
Cormni-sioners reviewing all Section 8 applicants prior to their approval! This.,
I believe to be a rather unusual situation!

There has been little activity taro contractors regarding bias on rehab projects:
this suampter. It is ry susp:cion that there is ton much other work for contractors
to want to bother with rehab jobs.

me of azsistance available to low incor..e homeowners through the GSA-CETA Weather-

Dear Mr. Willis:
We submit this proposal as per our discussion regarding an
audit of the Authority for the year ended December 31, 1977.
We will examine the financial statements of the Plymouth Housing
and Redevelopment Authority for the year ended December 31. 1977
in conformity with generally accepted accounting principles applied on
a consistent basis and also in conformity vAth federal audit require-
ments. We will perforin such tests of the accounting systems, accounting
data and accounting records as are required and necessary in the o!r-
cumstances. We will review the system of internal control as is required
by generally accepted accounting principles and auditing standards.
We anticipate the results of our examination will allow us to express
an unqualified opinion on the fairness of the presentation of the financial
statements in conformity with generally accepted accounting principles.
The procedures employed by us are not designed to detect the
existence of fraud. However, any findings that indicate a possibility that
fraud exists will be reported to the Authority.
Our rates charged for service will be the same rates charged the
City of Plymouth..
We appreciate the opportunity to be of service to the Authority.
If this letter fully expresses your understanding of the terms of our

Enclosed is our proposed Repayment Agreement for a Section 265 Program in
Plymouth, The intent is to prevent a wind -fall profit by a home buyer who
decides tc sell his house after only a short stay. We have used this
agreement for our Home Improvement Grant Program. It is patterned after
the MHFA agreement.
Would you please see if the HUD legal depart.^:ent would OK it for use with
