SUBJECT: Scattered Site Housing Program (Section 235)
On January 30, 1978 the Plymouth City Council approved the allocation of $58,000
of CDRS money for land write-down for the moderate income family Section 235
Housing; Program. The Section 2.35 Program has been established by the federal
government to assist lower income families in the purchase of single family homes.
The attempt is to provide lower priced single family homes on "scattered" parcels
over an entire community to diffuse the impact of tower income housing in a
community. Generally construction technics are standard in terms of materials
and site placement however "cost cutting" has often been employed by not bui-ldi-ng
a garage and keeping "frills" to a minimum, ie no landscaping materials and plain
exterior treatment. Placement, in the community, is critical as it is important
to locate the houses in a neighborhood of similar priced homes. lot selection,
then, is probably the most important single factor in making a Section 23.5 Program
work.
Staff has outlined the salient features of the present Section 235 Program as follows:
A. Eligibility Requirements
1. Must be a family (two or More persons related by blood, marriage or
operation of law) or a single person over 62 years old or handicapped.
2. Must have an "annual adjusted gross family income" not to exceed the
following:
a. 1 Person $12,900
b. 2 Persons $149750
c. 3 Persons 169600
d. 4 Persons 18,450
e. 5 Persons 199600 :y
f. 6 Persons 209750
g. 7 Persons 21000
h. 8+ Persons 239050
Note: "Annual adjusted gross family income" is computed by taking the annual gross
family income and subtracting out 5% of the gross income, excluding all income
received by eligible minors and a $300 deduction for each eligible minor.

C.. Mortgage Limitations
1. Mortgage amount cannot be more than $38,000 for a 3 bedroom home with
a Wximum sales price and FHA value of $45,600.
2. Where a family of five or more qualify for a 4 bedroom home tNe mortgage
amount cannot exceed $44,000 and the 'sales price and FHA value must
be under. $52,8000..
3. The value amounts are for the complete property, ie lot and structure.'
D. Downpayment Requirements

1. Normally is 3% of the FHA estimate of value and closing costs.
2. However when the sales price substantially exceeds the maximum
mortgage amount, the downpayment must be increased accordingly.

E. Subsidy Assistance to Homeowner
1. Assistance payments are made directly to the lender on homeowner's behalf
Z. Assistance paymen"bi-cannot exceed an amount which would be necessary to
reduce the mortgago interest costs to as low as 4%.
3. Homeowner must contribute at least 20% of his/her monthly adjusted gross
family income to mortgage payments
4. Homeowner's income is reviewed periodically and the owner's payment may
go up or d.!,wn according to his/her income.
F. Counseling of the Homeowner
1. Homeowners are to be counseled and/or given information on the responsi-
bilities of homeownership.
2. Lenders are to certify that homeowners have received HUD counseling
materials.
G. Steps for the Prospective Homeowner
1. Find a builder who would like to participate in the program and who can
build a house within the limitations of price and value.
2. rind a mortgage lender who is willing to make a mortgage loan under the
program and submit applications to FNA.
3. The lender reviews the prospective homeowner's income eligibility prior
to submittal of application to FHA.
4. A prospective homeowner's income may be too low to purchase a house even
with the subsidy provided.

At -Oft stage staff is working with the Housing and Redevelopment Authority
Chaftan, John Spaeth, at attempting to answer some of the concerns the Housing
and. Redevelopment Authority, the City Council andthe community at large may
have regarding scattered site housing. So far staff has conferred with Dennis
Daniels of the Bloomington Housing.and Redevelopment Authority (they have completed
eight homes under the Section 235 Program and will be doing 22 more shortly),
Chuck Cornea of the HUD staff who administers the program and Lynn Holman of the
Metro Council housing staff. In talking with these people, in addition to Chuck
Dillerud, City Planning Director, staff will correspond with the law firm of Lefevere,
Lefler, Hamilton andPearson (the -City's legal advisors) to determine the legal
constraints and pitfalls of the Section 235 program and how to avoid such.
Some problem areas and approaches staff and the Housing and. Redevelopment Authority
Chairman have discussed are:
Matter of "windfall" profit. How can Housing and Redevelopment Authority
be assurred that the homeowner does not turn around and sell the house within
a year or two and turn a "windfall" profit?
Now much subsidy does a builder need and what kind of subsidy will HUD approve?
Would an experienced builder or a less experienced builder be best?
Do double houses and condominiums qualify under HUD guidelines?
These and other questions staff hopes to have answered by the July meeting.

SUBJECT: Hennepin County 6 Proposal to Serve as Administrative Liason
for the M.H.f.A. Home Improvement Grant Program
Recently Hennepin County has requested permission to replace the Metro Council
staff in the position of administrative liason for the M.H.P.A. Home Improvement
Grant Program. In this regard, Hennepin County has circulated a letter from
Dale Ackmann, Coanty Administrator, outlining participating communities'
responsibilities in meeting the M.H.F.A. application requirements. These
requirements are as follows:
1. 'Resolution by'06 Plymouth City Council reauestieg that Hennepin
County apply for Phase III funding of the M.H.F.A. Home Improvement
Grant Program. '
2. Information on the qualifications of.those persons doing housing
rehabiliation inspections.
3. Process employed by the City of Plymouth in selecting home improvement
grant recipients.
4. Funding source and amount for administration of the City of Plymouth's
Improvement grant program.
Staff has put together the above information as an attachment to this memo. Staff
further believes that Hennepin County is a more logical. unit of government to
serve as administrative liason between the state and the community than is the
Metro Council and recommends the adoption of the attached resolution. Further
Metro Council Program Manager, Phil Katzung, also recommends local community
approval of Hennepin County as the grant administrating agency. The County has
enumerated the services it will provide in Its role as grant administrative organ
for the'M.H.F.A. home improvement grant program and this is attached hereto.

Dear Local Official of Hennepin County Community:
Hennepin County will be submitting an application by June 15, 1978, to
become an administering entity for the Minnesota Housing Finance Agency
MHFA) Home Improvement Grant Program, Phase III. The Metropolitan HRA,
who has served this function for Hennepin County communities, is encour-
aging your cooperation with the County for Phase I.11 (see attached letter)
Program administration will remain essentially the same as it was under
the Metropolitan HRA. An outline of the proposed County administrative
procedures is attached. Administration of the MHFA Home Improyement
Grant program by the County will further a coordination with CDBG housing
responsibilities and with the new CETA weatherization program. TFie grant
allocation plan is not yet available; however, 14HFA has indicated that
funding should be comparable to Phase. II. A distribution of,the.funding
schedule will be made as soon as it is available.
The County is seeking your cooperation in the development of the applica-
tion and encourages your participation in the program. In this regard,
you are asked to assist in meeting four application requirements:
1. Resolution - passage of a resolution requesting Hennepin
minty t`o apply for Phase III funding. To maintain the
application schedule,.this resolution should be passed
and a copy submitted to this office as soon as possible.
2. Inspections staff - inspector experience, training, and
background. As an example, specific information regard-
ing background (plumbing, heating, electrical, structural,
energy related, other), years of experience, licenses and/
or certifications are requested for those doing inspections.
This office additionally requests information on whether
local inspection staff is familiar with HUD Section 8
Existing housing standards. To be eligible for HUD housing
performance credit, rehabilitation activities must bring
a home up to Section 8 Existing standards.
3. Selection criteria and procedures - the identification
of select on criteria and procedures to be utilized during
the grant application process. MHFA discourages the use of

a "first come, first served" approach. Although it is
understood that some communities have used such an approach
successfully,. the County ,loins the MHFA in encouraging the
selection of an alternative approach. An alternative
approach might involve targeting of funds for particular
areas (i.e., NSA) or types of improvements (i.e., health
and safety) and' tray take the form of a point system, priority
list, or combination thereof. In consideration of the new
HUD rehabilitation standard mentioned above, all communities
are encouraged to include such.language in their selection
criteria.
You are also requested to indicate whether a grant review
committee will be used and how it will operate.
4. Local Funding. Share - indication of the source and amount
of local administrative share. Excluding the MHFA set
aside,,please indicate the source and amount of other adminis-
tration funding, i.e.,city funds, community development
funds, or other.
County staff will contact your community very soon relative to the.above
requirements.
The County is looking forward to working with your community in providing
housing assistance to local homeowners.

Your community has been participating with the Metropolitan Council
Housing and Redevelopment Authority in providing MHFA Home improve-
ment Grants to low income homeowners during the past year. The funds
for Phase 11 will be closing out on May 31, 197E with rehabilitation
work to be completed by August. 31, 1978.
MHPA has just announced that additional funds for a Phase III will be
available on July 1, 1979 and that applications -from agencies to
administer those funds must be received by June 151 1976. As in the
past, the Metro HRA will act as an administering agency in cooperation
with those communities who axe unable to provide program administration.

An Agency Crossed to Coordinate tbo Planning and'Devolopment of tho Twin Cities Metropolitan Area Comprising:
Proposed Administration of the MHFA Home Improvement Grant Program,
Phase III
County application to MHFA for administrative entity designation must
be submitted by June 15, 1978. The program will be administered through
the Development Planning-Unit/office of Planning and Development. Admin-
istrative tasks may be subcontracted with local communities as was the
procedure with Metropolitan HRA. Areas for subcontracting will include
inspections, rehab counseling, and preparation of portions of the grant
submission package. Details and signing of the contracts will be com-
pleted as soon as possible to maximize program utilization. Phase III
is scheduled for funding July 1, 190.
The County will provide appropriate staff to:
1. Assist local staff in training and orientation;
2. Provide technical assistance and .housing rehabilitation
counseling to participants from smaller communities;
3. Prepare income and ownership certificates, file liens.
and be a liaison with other County departments;
4. Manage and disburse grant funds;
S. Coordinate outreach program;
6. Coordinate efforts where possible with Community Development
housing responsibilities;
7. Provide general housing information as time permits.
Presently, each community will be allowed to use 3% of its total grant
allocation for administration. The County has developed its budget for
administration based on comments from MMFA and Metro HRA. Administrative
costs are also supported by a portion of the County Community Development

OUTLINE OF CITY'S ADMINISTRATION OF THE
HOME IMPROVEMENT DANT PROGRAM
A. Inspections
1. Inspections are normally carried out by 1411t Date, the Housing and
Redevelopment Authority programs administrator, with assistance from
the City Building Inspections Department as needed. The Housing
and Redevelopment Authority programs administrator has had experience
in single family home construction, has completed architectural design
courses at the university level .and has completed a university of
Minnesota extension school class in housing rehabilitation. As well, he
has administered the home improvement grant program and made inspections
during Phases I and Il of the M.H.F.A. grant program. In addition he
has made inspections for the existing Section 8 Rent Assistance Program
in the City of Plymouth.
B. Selection Process
1. The City of Plymouth has a Housing Rehabilitation Committee consisting
of 3 citizen members appointed by the Mayorl serving at the City Council's
discretion and directly responsible to the City's Housing and Redevelopment
Authority. The Committee normally meets once a month at City Hall.
This Committee acts as a grant review board and reviews all grant applicants.
2.. Process of selection of grant recipients follows the City's adopted
5-23-77) Home -Improvement Grant Pro ram Guidelines and Eligibility
Reauirements which are attached ereto.
C. Source and Amount of Funding for Program Administration
1. Funding comes from City funds through money budgeted out of the City's
General Fund, current Ad Valorum tax for the Housing and Redevelopment
Authority and from the M.H.F.A.

A. The City of Plymouth Housing Rehabilitation Committee shall abide
by the following criteria % selection of recipients for Grant
Funds whereby applicants with the highest point totals will be
considered over those with lower point totals:

B. Applications will be accepted as follows:
1. Applicants must submit their request for a Rehabilitation Grant
on the City of Plymouth or M.H.F.A. Grant Application form. It
shoald be submitted to the Planning Department, City Hall, 3025
Harbor Lane. _-.l.ymouth, MN, 55441. All applications should also

2. Applicjtiony'tji1 be reviewed by City staff as received and be
forwardea 1;9 tfje City's Housing Rehabilitation Committee for
their review and selection of recipients. Requests of an
emergency nature will be handled by staff as quickly as possible
and would be reviewed by staff and the Chairman of the Rehabil-
itation Committee. (See Section VIII. B.)

3. Deadlines for applications will be September 1..and December 1

4. After the deadline the Housing Rehabilitation Committee will
review and select grant recipients using the criteria as in
Section VII. This selection process will take :place on the
thfrd Wednesday of the month following the deadline date, i.e.
the third Wednesday of September and the third Wednesday of
December.
S. The decision .of the housing Rehabilitation Grant Committee will
be final, however, appeals may be made to the City HRA in those
cases There applicants believe they were not treated equitably.
VIII. Miscellaneous
A.
B.
Inspections of Property
1. It is not the intent of the Rehabilitation Grant Program to
conduct inspections to find violations of the City Building
Codes. However, major infractions that constitute a health
and/or safety hazard or seriously diminish the :habitability
of the residence will be noted and explained to the homeowner.
If the homeowner is determined to be eligible for a grant,
serious infractions will be remedied at that time. Should
the homeowner not be eligible for grant Ponies, the homeowner
will be informed of the infraction by the City Building Department
and a period of time will be established during which the infrac-
tion would be remedied.
2. Inspections will normally be conducted by the staff adminis-
trator of the program and not by a member of the City Building
Department.
Criteria for Emergency Funding
1. Staff will consider those grant requests as emergency requests
where.-
a.
here:
a. The dwelling unit contains defects or deficiencies which,
if left uncorrected, would render the unit immediately
uninhabitable or contain serious health or safety hazards.
b. The defects or deficienciesare the direct result of
natural causes such as floods, droughts, tornados, fires
blizzards and storms or mechanical failures such as burst
pipes and furnace break -downs.

2. Where no funds are available for assistance to eligible
homeowners the following procedure shall be used:
a. Upon notification by the homeowner of an emergency
situation, administrating staff and a member of the
City Building Department will inspect the property at
the invitation of the homeowner.
b. Staff will note in a written form those defects or
deficiencies of an emergency nature and contact
eppro riate trades.persons to obtain a. cost estiM4te
to make necessary improvements.
c. Administrating staff will transmit this information
to the Chairman of the Housing Rehabilitation Committee
for his review.
d, Administrating staff will forward the comments of.the
homeowner, Building Inspector and Housing Rehabilitation
Committee Chairman to at least two ynembers.of the
Plymouth HRA.
e. Administrating staff will prepare,a memo regarding the
emergency request including all related comments to be
submitted to the City Council at the earliest possible
meeting. This memo and attachments shall include the
following minimum information:
1 Nature of the emergency
2 Eligibility of the homeowner
3 Homeowner Application for Grant
q Repayment Agreement (or assurances Repayment Agreement
has been signed.)
6) Cost estimates from tradespersons to make the necessary
improvements
6) Recommendations of the Administrating Staff, City
Building Inspector, Chairman of the Housing Rehabil-
itation Committee and the contacted HRA members.
I The City Council will have the option upon review of an emergency
grant request to:
a. Refer the request to the Minnesota Housing Finance Agency for
an emergency grant;
b. Make an appropriation to the applicant from such 'Fund as deemed
appropriate; or
c. Deny the request.

Existing Construction
As approved earlier this year, 25 additional units of Section 8 Existing Construction
has been approved for the City of Plymouth by HUD. We are now required to execute
a contract with HUD. This contract is not available as of the date of the memo
but a telephone conversation on this date from a HUD Area Office personnel indicates
tha:contract: ptiil. be forthWing in time for the June 26th meeting. A resolution
authorizing that the Chairman of the Housing and Redevelopment-Autho's ity execute
the Annual Contributions Contract.

The Metropolitan Council is in the process of updating the
Subsidized Housing Activity" report. :he last report was published
in December of 1976. This information is important because it is
used in the Subsidized Housing Allocation Plan, housing performance
evaluation and in a.number'of other reviews.
In the interest of accuracy, we are submitting the information we've
compiled to each community for their review. prior to publication

on the units previously funded under the 235 program (prior to 1976)

existing housing to be assisted by housing assistance payments pursuant to
Section 8 of the United States Housing Act of 1937 is approved; (2) annual
contributions contract arthority in the amount of $76,416 has been reserved
for the member of units and unit size distribution specified below; and (3)
the Annual Contributions Contract is being prepared and will be forwarded to
you for execution.

2. Minor revisions to Admission.Policy - i.e., updated income limits,
revised FMR's, and substitution of "reasonable" for "approvable" on
page 6, Part V B2.
3. Schedule of Allowances for Utilities rand Other Services, Form HUD 52667
must be revised to eliminate allowance for air conditioning.
Please submit these items within 30 days of the date of this letter. Upon
request, this Office will be glad to provide any assistance you may need in
the preparation of these items.- Should your agency require additionsl copies
of the above forms, we will mail them to you upon request.
With respect to Housing Quality Standards, it should be understood that initial
code compliance inspections by the City cannot be depended upon as evidence of
compliance with the Standards at the time of Section 8 occupancy. An inspection
by the HRA immediately prior to proposed Section 8 occupancy is essential, as
are.tegular re -inspection of the units.

the South-west quadront of Highway 55 and County Road 18 in Plymouth
as follows:
1. When: do you anticipate completion and rent -up starting tinge?
2. Who will be your rental manager?
3. How will you select Section 8 renters?
My interest in this project stems from the fact that I am currently
administering a Section 8 program for existing -construction in Plymouth
and I have generated a backlog of prospective Section 8 renters for our
program. However it will be a wait of several months for some families
on the 'ist. In this regard, perhaps your apartment project may be a
solution.

We submit this propos:-1 as per our discussion regarding an
audit of the Authority for the year ended December 31, 1977.
We will examine the financial statements of the Plym,)uth Housing
and Redevelopment Authority for the year ended December 31, 1977
in conformity with generally accepted accounting principles applied on
a consistent basis and also in conformity v4th federal audit require-
ments. We will perform such tests of the accounting sy9tem, accounting
data and accounting records as are required and necessary in the cir-
cumstances. We will review the system of internal control as is required
by generally accepted accounting principles and auditing standards.
We anticipate the results of our examination will allow us to express
an unqualified opinion on the fairness of the presentation of the financial
statements in conformity with generally accepted accounting principles.
The procedures employed by us are not designed to detect the
existence of fraud. However, any findings that indicate a possibility that
fraud exists will be reported to the Authority.
Our rates charged for service will be the same rates charged the
City of Plymouth.
We appreciate the opportunity to be of service to the AuthLrity.
If this letter fully expresses your understanding of the terms of our
engagement with the Authority, please sign one copy and reiurn it to us.
