Adjournment CITY OF PLYMOUTH 3025 HARBOR LANE, PLYMOUTH, MINNESOTA 55441 TELEPHONE (612) 559.2800 KATE: October 20, 1976 MEMO TO: Plymouth Housing h Redevelopment Authority FROM: Milt Dale, Associate Planner gUBjECT: Progress Report on Hc+me Improvement Grant Program 4 Section 8 Housing Assistance At its Septaher 27th meeting, Commissioners adopted a resolution adopting; a procedural approach for the Home Improvement Grant Program and a resolution to appoint a grant committee. The City ;staff has publicized the grant program in several ways, ;..e. Radio WWPC, the newspaper, homeowner associations, etc. As well, Mr. Mack *Cwghey, President of the Plymouth Sr. Citizens Club explained the grant program at an October 18th Club meeting and he has also "recruited" a prospective grant recipient. Mr. McGaughey has consented to sit cis the Grant Casnittee and his counsel mW assistance has proven invaluable. That Grant C mittee':; first meeting was on October 19, 1976 at Mr, Wa ey's residence. The Coma ittes discussed the difficulty of obtaining prospects who would qualify considering the eligibility requirements, i.e. a gross income of under $5,000.00 and ownership of a home. The matter of pride among senior citizens and their probable reluctance to apply for a grant was also discussed. It was therefore suggested by Cotmcilman Hunt and agreed to by the Committee, to mail out a letter of explanation of the program and a sample application to Plymouth Senior Citizen Club members living in Plymouth. This letter would stress the confidentiality of every response. Approximately 60 letters will be mailed out, In addition, Committee members agreed to rate grant applications as follows: First Priority - Senior Citizens (over 62 yrs. old) Second Priority - Insulation improvements Third Priority - Health and Safety Improvements The deadline to mail in applications has been extended to I)ecember 1 from November 1 due to the lack of initial response. For some reason most of the telephone inquiries regarding the grant program have come from Minneapolis residents! The Committee will greet again in December to select recipients of grant funds. The contract between the Metro Council and the City of Plymouth regarding. the disbursement and administration of grant monies has been forwarded by staff to the City Attorney for review. This contract should be ready for signing shortly. On September 29, 1976 the City staff received notice from Joseph Gabler, Acting Area liaising f Urban Development Director, that the Plymouth Housing & Redevelopment Authority's application was approved subject to final approval by their Legal Section, Housing Management b Equal Opportunity Divisions. Recent corm dcations with these three departments indicates their approval is highly likely. An annual contributions contract of 67,752.00 has been reserved for the Plymouth Housing Assistance Program. 1- Plymouth Housing $ Redevelopment Authority Page Two Presently staff is completing the Section 8 Housing Assistance budget and Administrative Plan. The latter is a rather esoteric document of some twenty pages detailing the procedures, relationships and staffing hours and costs for the upcoming year (December 31,1976 through December 31, 1977) the housing program would be operaticul. busing & Urban Development has prepared a 16 page report on the guidelines for developing an Administrative Plan and this report is to be followed in a very prescribed fashion. The local Housing & Urban Development office is holding a briefing meeting in early November on how to prepare an Administrative Plan however staff would like to have their Plan fairly well completed prior to this meeting. This will enabae the Plymouth Housing $ Redevelopm=t Authority to get an earlier start into the Housing Assistance Program, It is anticipated at this time that the "kick-off" for the dousing lssist.:nce Program will V'° f4xember 31, 1976. METROPOLITAN C 0 U N C I L Suite 300 Metro Square Building, Saint Paul, Minnesota 55101 COOPERATIVE"REHABILITATION GRANT PROGRAM CONTRACT WITH MUNICIPALITY THIS ACREEMENT, entered into this day of P 1976 between the Metropol an Council (here a ter referre to as the Council) and the City of (hereinafter referred to as the Cit:) . WITNESSETH; i4HERHAS, the Coun+cil intends to undertake a program for the disbursement of grants to improve residential property for eligible families and in* dividuals, in the Metropolitan Area; and WHEREAS, the Council has entered into an agreement with the Minnesota Housing Finance Agency ("KHPA") to act as an administering entity for the utilization and disbursement of such grant funds,; and WHERZA$, the City has by resolution indicated itsdesire to participate in this program and to assist such individuals and families to improve their housing in the City; and WHEREAS, the Council desires to purchase certain necessary .administrative services from the City in connection with carrying out the program; and WHEREAS, the Council is authorized to execute an agreement for the purchase of program services and to take all action specified or contemplated herelr pursuant to Minnesota Statutes (1975 Supp.) Section 473.129, Subd. 3, Section 473.19, Subd. 1, and Section 473.195, and has all of the powers and duties of a housing and redevelopment authority pursuant to Minnesota Statutes 41975 supp.)Section 473.195 under the provisions of the Municipal Housing and Redevelopment Ac.t, Minnesota Statutes Section 462.41. to 462.71 and acts amendatory thereof; NOW, THEREFORE, in consideration of the mutual covenants and promises contained herein, the parties agree as follows: 1. The City agxees that in all aspects of carrying out the rehabilitation grant program it gill comply with the provisions of this agreement wid regulations set forth in the MHFA Home Improvement Grant Program Procedural Guides, Appendix A attached hereto and hereby incorporated as part of this Agreement. b. For the purpose of this Agreement, requit4&aents, dirties, obliga- tions and warranties of an "administrative antiyty" established by the MWA Home Improvement 'Grant Program Procedural Guides shall constitute requirements and duties of the City. Obligations and warranties of an "administrative entity" to the MHFA created by the IOWA Procedural Guides shaU conetitute obligations and warranties of the City to both the Council and the MMA. 4. 'The City shall use its best efforts promptly and with due diligence to utilize the grant funds allocated to it; and shall utilize all grant funds allocated to it by August 31, 1977. The City shall commence to cake grants complying with the terms hereof from and after the date on which the Agreement .becomes effective by providing publicity about the program and technical assistance to grant .recipients in complying with the -terms and, conditions of the MH'FA Home Improvement Grant Procedural Guises. 6. The Council shall use its best e£forte promptly and with due diligence to provide training to Cit_ staff on procedures and techniques for administering and providing technical assistance to grant recipientsr and shall disburse grant funds allocated to the City eccording to the terms avA conditions of the MHFA Home Improvement Grant Program Procedural Guides. 7. The Council shall reimburse the City for the costs of administering and providing technical assistance to grant recipients up to the maximum allowable pursuant to paragraph 2 of this agreement. Such reimbursement shall be made upon request of the City after all grant funds have been committed and upon itemized documentation as to the nature of the expenditures. S. The Agreement may be terminated at any tishe by either party upon ten days prior written notice to the other party. In the event of such termination, the Council shall thereafter disburse grant funds with respect to all individual grant applications which, prior to the effective date of said notice of termination, shall have received MHFA approval and authorization to commence work and each party shall be required to carry out the terms of the Agreement with respect to each of such grants. 9. The City in accordance with its status as an independent contractor agrees that it will conduct itself consistent with such status and that it will not hold itself out or claim that its officers and em- ployees are employees of the Council. By reason hereof, it will make no Claim, demand or application to or for any right or privilege applicable to any officer or employee of the Council, including, but not limited to workman's compensation coverage, unemployment insurance benefits, social security coverage or retirement membership or credit. 14. Al! matters, whether sounding in tort or in contract, relating to the validity, construction., performance, or enforcement of the xgreement shall be determined according to the laws of the State of Minnesota. ll. If any termor provision of the Agreement is .finally judged by any court to be invalid, the remaining terms and provisions shall remain in full force and effect, and they shall be interpreted, performed, and enforced as if said invalid provision diff not appear herein.
