Adjournment MINUTES OF REGULAR MEETING OF THE HOUSING AND REDEVELOPMENT AUTHORITY OF PLYMOUTH, MINNESOTA February 17, 1976 A regular meeting of the Housing and Redevelopment Authority of Plymouth, Minnesota was held on the 17th day of February, 1976, at 12:20 A.M. at the City Council chambers in the City of Plymouth, Minnesota. All members of the Authority were present, as follows: Chairman Hilde, Commissioners Hunt, Neils, Seibold and Spaeth. There were also present the following members of the City staff: Manager Willis, Planner Dillerud and Secretary Garrity. The Secretary read the call of the meeting and moved that the minutes of the January 26 organization meeting be approved as submitted. The motion was seconded by Chairman Hilde. Motion carried, five yeas. It was moved by Commissioner Seibold, seconded by Commissioner Hunt, to make recommendation to the City Council to consider using CDRS funds for an HRA analysis of housing, land and transportation. Energy independence goals elude U.S. The Pealeral Energy Administration fEn) is preparing an update of its Proj- ect Independence report that indicates that it is becoming increasingly difficult for the U.S. ever to achieve energy in- dependence. The document, which is still subject to change, shoves that cur- rent oil imports of 6 trillion bbl per day could drop to 3.8 million bbl by 1983, but that they could not reach zero im- ports. Recent changes in oil depletion tax allowances and revisions of oil resource estimates by the U.S; Geological Survey are the main reasons for the changes. Last year FFA predicted the U.S. could boost its oil production front 9 million to 13.1 millior bbl by 1985 if current policy doesn't change. Now the agency concludes that only 12.9 million bbl per day will be produced in 1985. Even that toed assumes an aggressive development e0ort. Accelerated supply schemes could boost the bill to 5340 billion to 5569 billion, the report says. 1 1471: VNR 9 PURCHASE OF SERVICES ACRE1.76M NIS AGREEM N17, entered into as of this 29th day of March , 1976, by and between the Housing and Redevelopment Authority of Plymcuth, Minnesota, a body public and corporate, (hereinafter called "H.R.A."), and City of Plymouth, a municipal corporation organized and existing ander the laws of the State of Minnesota (hereinafter called Plymouth"), W11WESSFnI I: WHEREAS, the H.R.A. desires to engage Plymouth to render certain technical. advice and assistance in connection with the activities and projects of the H.R.A., NOW, 1TIEREFORE, for and in consideration of the mutual covenants and agreements herein set forth, the H.R.A. and Plymouth do hereby agree as follows: 1. Scope of Services to be Supplied by PI)Muth: Plymouth shall fur- nish to the H.R.A. all necessary services required by the Authority and as called for by the Authority, including. but not limited to, furnishing the service. of an Executive .Director, a Director., Finance Director, Engineering Staff, Planning Staff, Attorney, and Secretary (all hereinafter called "Services"), and related equipment as below described and referred to all hereinafter called "Equipment"). a. The Executive Director shall be the Manager of Plymouth. fle shall have responsibility for the general supervision of the projects of the I-I.R.A. and supervision of the personnel of Plymouth who are to furnish services to the H.R.A. pur3uant to this agreement. lie shall perform, or have performed, such activities as the Ii.R.A. shall from time to time reasenabl-, request. lie shall act as treasurer of the H.R.A. and he shall be respct sibl.e for the care and custody of all favids of the H.R.A. and for :he deposit thereof in the name of the H.R.A. in such bank or banks as the H.R.A. from. time to time shall designate; for the keeping of regular books of accounts showing receipts and expenditures; for rendering to the I-I.R.A., at each regular meet- i.ng. of `.Ire M.R.A., of an account of the income and expenses of the H.R.A. .for the then prior raDnth; for rendering of such additional financial and other reports as the H.R.A. from tine to time shall request. h. The Director shall be the Planning Director of Plymouth. He shall perform all duties required by the Executive Director, including, but not limited to, the following: coordinating and supervising all aspects of the planning and development of projects of the H.R.A., including work of and between consultants, contractors, and other employees of Plymouth who are to provide services to the M.R.A. pursuant to this agreement; supervising and coordinating with, answering and acting on requests of, and meeting with representatives of, ocher units of government; meeting with and counseling local community groups and residents., and all other duties properly and reasonably requested by the Executive Director. C. The Finance Director shall be the Finance Director of Plymouth, and shall perform all duties required by the ''xecutive Director, including, but not limited to, the following: preparation and maintenance of all financial books and records, and si pervision of the disbursements of funds; prepara- tion of at least monthly reports reflecting income and expenditures; prepara- tion of recommendations for a budget and budget revisions, internal audits, and other checks and revisions of the financial status of projects; maintenance of all. payroll, related accounts, including documentation of amounts to be billed under the terms of this contract.; and all. other duties necessary to the financial administration of the Authority and its projects. d. lice Engineering and Inspection Staff shall consi-•t of. the Public Works Director of Plymouth and his staff, and shall per )yin'all duties required by the Executive Director, including, but not 11 ri'ed ro, fae following: all engineering and inspection work necessary to the timely and.. su cessful completion of all work needed in connection with Authority projects and not contracted for by the Authority with other engineering consultants or contractors; coordination of all. engineering work; public works recommendations; review of plans and specifications for project improvements prepared or submitted by ronsultants or contractors; pr -,para - tion of plans and s;R: s for all clic improvements projects; and review and recormnena=:':.i- all plans as they may relate to streets, highways, sidewalks, ai;.,ys, utility servires, and construction techniques. 2- C. The Planning Staff shall consist of t}le Planning Director and Planning Staff of Plymouth, and it shall perform all duties required by the Executive Director, including, b -it not limited to, the following: All planning and administrative wo k necessary to the timely and successful completion of all Authority projects; coord'^ation of all planning work; and review and recommendation on all plans as they relate to land use, land controls, and other general planning activities. f. The Attorney shall be the Attorney of Plymouth, and his assistants, and stiall perform all duties required by the Executive Director, including, but not limited to, tide following: all legal work necessary to the timely and successful completion of the projects of the Authority; drafting and reviewing contracts; rendering legal advice and opinion on matters relating to the projects, when required by the H.R.A.; attending meetings of the H.R.A.; and assuring that its activities in relation to the projects' activities are in conformance with local, state and federal law. g. figuipment shall include office space, supplying of normal daily business postage and office supplies, use of telephone-, and telegraph and reproduction equipment, car expense, travel expense, and such other items as from time to time may reasonably and properly be needed by the Authority and as Plymouth may then agree to provide. 2. Time of Performance; Duration of Agreement: 'Mis agreement shall. commence as of January 26, 1976, and shall continue until January 1, 197:, wnd shall continue thereafter on a year-to-year basis unless and until ternizuted by either party hereto by notice given to the other on or before June 1 of any year, and this agreement shall then terminate at the end of the calcridar year in which such notice is given. 3. Compensation to Plymouth a. Payment. M.R.A. shall pay Plymo!ith for all Services and Equipment furnished to the N.R.A. F ayments shat t be for all. Services and Equipment furnished by Plymouth be made within thirty (30) days after receipt by the H.R.A. of a statement from. Plymouth for the period for which payment is to be made. 3- b . for Services. The amount to be paid by the I -I. R.A. to Plymouth for services shall be the total hours of Services actualiy rendered each mon't to the H.R.A. by each employee of Plymouth tames the Hourly Rate for each such employee plus 50% of such rute for overhead. c. Equipment, Supplies and Reproduction. The amount to be ;)aid. to Plymouth by the H.R.A. for equipment, supplies and reproduction expense shall be the cost to other City departments for such. items. d. Attorney. The fees of the Attorney will be based upon the then prevailing hourly fees charged to Plymouth times the number of hours services have been rendered to the M.R.A. e. Travel. No travel expenses outside of the Minneapolis - St. Paul Metropolitan area shall be charged to or paid by the II.R.A. unless the Executive Director has consented thereto in writing in advance of the expenses being incurred. If so consented to, only actual out-of-pocket expenses for travel., food, and :lodging shall be reimbursed by the [I. R.A. 4. The Engineering and, Inspection Staff shall consist of the Wil:ic Works Director of Plymouth and his staff, and shall perform all duties required by the Executive Director, including, but not limited to, the following: all engineering and inspection work necessary to the timely and successful completion of all work needed in connection with Authority projects and not contracted for by the Authority with other engineering consultants or contractors; coordination of all engineering work; public works recommendations; review of plans and specifications for project improvements prepared or submitted by consultants or contractors; prepara- tion of plans and specifications for all public improvements projects; and review and recommendation on all plans as they may relate to streets, highways, sidewalks, alleys, utility services, and -:onstruction techniques. 2- e. The Planning Staff shall consist of the Planning Director and Planning Staff of Plymouth, and it shall perform all duties required by the Executive Director, including, but not limited to, the following: All planning and administrative :,perk necessary to the timely and successful completion of all Authority projects; coordination of all planning work; and review and recommendation on all plans as they relate to land use, land controls, and other general planning activities. f.
