R ESOLUTION A PPROVING A R EQUEST TO D ENY A CCESS TO 41 A VENUE N ORTH
AND AN E NCROACHMENT A GREEMENT FOR D ANIEL AND J ENNY R EED F OR P ROPERTY
L OCATED AT 4095 G OLDENROD L ANE N ORTH (PZ2019-079)

WHEREAS, Daniel and Jenny Reed have requested that access to 41 Avenue North be denied for
their property located at 4095 Goldenrod Lane North legally described as:
Lot 1, Block 2, Mission Trails, Hennepin County, Minnesota.

WHEREAS, the property is a double-frontage lot abutting both Goldenrod Lane and 41 Avenue;
and,
st
WHEREAS, the Mission Trails was approved in 1985 and the City has no record if access to 41
Avenue was denied; and,
st
WHEREAS, 41 Avenue is a minor collector and without this action the yard between the home
st
and 41 Avenue may not be considered an equivalent side yard; and,
st
WHEREAS, the City has fence setbacks that are greater if access to 41 Avenue is permitted and
st
the applicant would like to construct a six-foot fence up to the right-of-way for 41 Avenue; and
WHEREAS, the proposed fence would be located outside the site visibility triangle for Goldenrod
st
Lane and 41 Avenue; and,
WHEREAS, an encroachment agreement is required to allow a portion of the fence to be
constructed within a drainage and utility easement.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,

MINNESOTA, that the private driveway access to 41 Lane North from 4095 Goldenrod Lane North is
denied and an encroachment agreement to allow a portion of a fence to be constructed within a
drainage and utility easement is approved.
ADOPTED by the City Council on this 8th day of October, 2019.
