R ESOLUTION N O. 2019-279
R ESOLUTION A PPROVING R EQUEST FOR P AYMENT N O. 4 AND F INAL FOR
THE M EDINA R OAD AND R EVERE L ANE T RAIL PROJECT
(PR189001.001 & PR189001.002)
WHEREAS, the City of Plymouth as the owner and BKJ Excavating, as the contractor, have
entered into an agreement for the Medina Road and Revere Lane Trail Project. Said agreement was
approved by the City Council on June 26, 2018; and
WHEREAS, the Engineer has certified his acceptance of the work and his approval of the request
for final payment.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA:
1. That the original contract amount was $308,327.75 and the value of the work to date is
$313,490.30 and is approved. The final contract amount is $5,162.55 above the original contract
amount.
2. That the work performed by the contractor for the Medina Road and Revere Lane Trail Project
and certified to the Council by the engineer as acceptable, being the same, is released from the
contract except as to the conditions of the performance bond, any and all legal rights of the
owner, required guarantees, and correction of faulty work after final payment.
3. Request for Payment No. 4 and Final in the amount of $15,674.52 to BKJ Excavating for the Medina
Road and Revere Lane Trail Project is approved and the Administrative Services Director is
authorized and directed to pay the same forthwith.
4. The project shall include 5% for engineering and administration costs in the amount of
$15,674.52 for a total project cost of $329,164.82.
BE IT FURTHER RESOLVED, that the funding for this project is from the Park Dedication Fund in
the amount of $329,164.82.
APPROVED by the City Council on this 8th day of October, 2019.
