CIM – 27th Place North Street Removal
1. Background
Earlier this summer Staff identified the segment of 27th Place North, between Zanzibar Lane North
and the Maple Creek Park, as needing accelerated pavement maintenance due to the presence of
heavy pavement distresses. This segment of roadway is unique in that due to how development
occurred, the roadway is not connected to any other roadways, does not provide access to any
driveways, and does not meet City standards for a turnaround. Prior to completing maintenance on
the pavement Staff evaluated the potential of removing the roadway segment and replacing it with
a trail rather than accelerated pavement removal.
Considerations evaluated include:
No plan exists to remove the Maple Creek Park playground and connect 27 th Place North
thru from Zanzibar Lane North to Weston Lane North.
The roadway does not connect to another City Street or any private driveways.
The roadway does not meet current requirements for a turnaround.
Removal of the roadway reduces maintenance costs to the City in the long term.
Public Safety has reviewed and has no concerns with removal and replacement with a trail.
Parks and Recreation has reviewed and has no concerns with removal and replacement with
a trail. Parks and Recreation will be responsible for future maintenance.
The roadway is used as a parking and access location by park patrons. Based on feedback
from property owners, Staff believes this can still be accommodated via a new trail
connection and on-street parking (available on Zanzabar Ln. N. and adjacent cul-de-sac.
Staff evaluated 90 degree and angled parking off of Zanzabar Lane North, but due to safety
concerns with the proximity to the intersection, is not recommending at this time.
2. Neighborhood Feedback
A letter was sent to neighboring property owners to elicit feedback on the removal of the roadway.
Emails were received by five property owners with the majority being in favor of removing the
roadway and replacing with the trail. A copy of the letter that was mailed to property owners and a
summary of feedback received is attached.
3. Proposal
Staff is planning to proceed with the removal of the segment of 27 th Place North, between Zanzibar
Lane North and the Maple Creek Park this fall. Staff will look at what improvements can be made to
drainage on the existing trail and will coordinate restoration seed mixes with adjacent property
owners. Work will be completed using City forces and street maintenance funds.

The City of Plymouth is considering removing the segment of 27 th Place North that exists between
Zanzibar Lane North and the Maple Creek Park (see highlighted red area on the map included with this
letter). If this segment of roadway were removed the park trail would be extended out to Zanzibar Lane
North and the remainder of the area seeded to remain as open space next to the park. The roadway on
the east side of the park would remain as it exists today.

Hi,
My husband and I have lived in our house on 27th Ave for 32 year and LOVE all the walking trails!! We use
them every day!!
I have no concerns with closing that road and leaving a path to Zanzibar from the park. I do hope that when
you tar the path(circled in red) you put a culvert under the path to prevent all the flooding that happens in that
area every spring and during heavy rain! We always end up walking in the people’s yard to the north of the trail
to avoid the deep waters.
I have a HUGE REQUEST! We walk the trails year round and the path from the park down to the trail(marked
in yellow) is NEVER NEVER plowed...the plow goes across the north side of the park and out on to the street,
why can’t he go down the path instead of out on the street! As I am getting older it is very hard to navigate the
trail thru all the frozen foot steps and deep snow!! I have asked about this before but apparently to only fall on
deaf ear, hopefully we will see plowed paths or a REALLY GOOD REASON whynot! Thank You asking us
about this plan and I hope you can consider the culvert and the snow plowing!! Cindy Bouma

I've received your letter regarding the proposed removal of the road segment of 27th Place North at Maple
Creek Park, and extending the park trail.
My lot is next to this road. I am strongly in favor of this change.
The road segment seems to be in a constant state of disrepair, and the area where the road meets the park
entrance is particularly in rough shape. Extending the trail would clean this up and look more appealing.
On any given nice weather day there might be a maximum of 3-4 vehicles parked on this segment as they visit
the park. You might receive some objections from residents who like to park there. I submit there is plenty of
parking on Zanzibar Ln N for the few who like to drive to the park.

Hello Barb and Michael,
I live at 2760 Zanzibar lane N. and although I kinda like your plan to do a path straight threw I've noticed on
our Facebook page a few people are concerned about parking for park.
I take two walks a day in the park and have for 5 years or more and haven't but once or twice seen more than
2 cars parked. my idea would be to just add two parking spots where the path would meet Zanzibar lane.
and my only other concern is that it would be prudent to put a culvert across path or else you will be replacing
tarmac within a few years..alot of water runs from the north lot to the south.
I will send a drawing of the parking idea and roughly where culvert should be

maintenance costs. Also we have a fairly active neighborhood that would keep up the area accordingly if that

City seeks volunteers to help with Buckthorn Busts
Plymouth, Minn. – The City of Plymouth is seeking volunteers to help with five upcoming Buckthorn
Busts – an annual series of coordinated efforts to remove the invasive plant from the city.
Buckthorn Busts are scheduled as follows:
•9 a.m. to 1 p.m. Saturdays Oct. 19, Oct. 26 and Nov. 2 at Maple Creek Park, 16099 27th Ave. N.
•9 a.m. to noon Saturdays Oct. 19 and Oct. 26 at Hardenbergh Open Space, 18025 12th Ave. N.

About Buckthorn Busts
According to the Minnesota Department of Natural Resources, buckthorn is designated as a restricted
noxious weed in Minnesota. It's illegal to import, sell or transport common, European, glossy or alder
buckthorn in this state. The invasive species chokes out native plants, reproduces rapidly and dominates
the area.
Weed wrenches and other tools can be borrowed from the city. Resources needed for busts include
gardening gloves, shovels, sheers, a hand-held saw and an herbicide. Buckthorn must be pulled by the
root to be effectively eradicated from the area. Shovels may be needed to remove larger, well-rooted
plants, while gardening sheers may be used to cut the smaller shoots.
If the root remains, it will sprout again. If removal of the root is not feasible, an herbicide, such as
Roundup Concentrate Plus with 18-20% glyphosate, can be applied to the freshly cut buckthorn stump
to prevent it from growing back. If an herbicide is not applied to the stump, five to eight shoots will grow
up around the previously cut area.
Residents Encouraged to Organize Neighborhood Buckthorn Busts
Residents are encouraged to organize their own neighborhood Buckthorn Busts. For help getting a group
started, email volunteer@plymouthmn.gov or call the city’s volunteer coordinator at 763-509-5230.
Cutline: The City of Plymouth is seeking volunteers to help remove invasive buckthorn from the city.
Buckthorn removal is best accomplished in the fall, as its leaves remain green and are more visible.

Plymouth Police participate in National Coffee with a Cop Day Oct. 2
Plymouth, Minn. – The Plymouth Police Department is set to participate in National Coffee with a Cop
Day 7:30-9 a.m. Wednesday, Oct. 2 at Caribou Coffee, 16725 County Road 24.
Residents are invited to stop by and get to know some Plymouth Police officers in an informal setting.
The annual event encourages communication and positive interactions between law enforcement and
the public – and aligns with the Plymouth Police Department's focus on community outreach.

City of Plymouth seeks volunteers to adopt a storm drain
Plymouth, Minn. – The City of Plymouth encourages residents to adopt a storm drain and keep
them clear of sticks, leaves and debris.
It’s easy to do – and a great volunteer opportunity for families and groups. Just a rake or broom
and some gloves are needed. Sticks and leaves can be deposited at the Plymouth Yard Waste
Site, 14900 23rd Ave. N., while litter can be trashed or recycled.
Every fall, leaves line the streets and wash into storm drains. Cleaning storm drains is essential
to protecting lakes, streams and wetlands from excess pollutants and nutrients, which
encourages the growth of unwanted algae.
To adopt a storm drain, contact the city's volunteer coordinator at 763-509-5230 or
email volunteer@plymouthmn.gov.
Storm Drain-Marking Kits Available
The City of Plymouth loans storm drain-marking kits to residents. The message – no dumping,
drains to lake – helps educate neighbors about storm drains and their relationship to water
quality.
Residents are encouraged to borrow the kits and mark their neighborhood storm drains to help
remind neighbors that water and debris drains straight into lakes, streams and wetlands
untreated.
To borrow a kit, call Interim Water Resources Manager Ben Scharenbroich at 763-509-5527.
Kits can be picked up at Plymouth City Hall, 3400 Plymouth Blvd.
Cutline: Residents are encouraged to adopt a storm drain and keep them clear of debris. Drain-

City of Plymouth offers open swimming through Dec. 13
Plymouth, Minn. – The City of Plymouth offers open swimming 6:45-8:30 p.m. select Friday nights this
fall at the Wayzata East Middle School Pool, 12000 Ridgemount Ave. W.
Open swimming is available on the following dates:
•Oct. 4, 11 and 25
•Nov. 1, 8, 15 and 22
•Dec. 6 and 13
Open swimming participants should enter Wayzata East Middle School on the south side of building at
the “Community Pool” door.
The cost of entry is $5 for children and adults. Cost for families of four is $15. Participants must bring
cash, as other payment methods are not accepted.
Non-swimmers and children under 3 feet tall or younger than 6 must be supervised by an adult. Youth
must also be accompanied by an adult.
A swim test is required for use of the diving board and deep end of the pool. A lap lane is also available.
Toys, noodles and life jackets are allowed. Water wings and inflatables, including inflatable swimsuits,
are prohibited.
Open swimming provides an opportunity for fitness and family fun without a gym membership. The

Hennepin County targets hard-to-
count communities for 2020
census

Self-response to the census survey starts April 1, followed by several months when census workers will
be tracking down people who don't file their data.
Months before the 2020 census kicks off in April, Hennepin County is working ahead to ensure hard-to-
count areas and communities are tallied and to sweep away obstacles that might discourage residents from
filling it out.
“Do they have issues with hacking or the citizenship question?” asked Alisa Salewski, the county’s chief
innovation officer. “We need to know the blocking points and remove those barriers.”

Other factors that could influence the count include disinformation, fairness and accuracy, and privacy
issues.
No specific goal has been set for next year’s census, Salewski said. It’s hard to predict the results because
2020 will be the first census done electronically. In the 2010 census, the participation rate was 81% for
Minnesota and 82% for Hennepin County.
Gathering data for the census started in 2017 when Hennepin County officials asked cities for resident
address updates. The county created a census task force in 2018 and this year established field offices and
“diverse count committees” to engage residents in the census process.
The Hennepin County Board received a recent update on the county’s comprehensive plan to ensure data is
as complete and accurate as possible. While English is the most common language spoken in Hennepin
County, the census is offered in dozens of languages — though not Oromo, Commissioner Angela Conley
noted at the briefing.
Self-response to the census survey starts April 1, followed by several months when census workers will be
tracking down people who don’t file their data.
It’s estimated that 235,000 county residents won’t respond without additional follow-up. The count
committees have proved to be the best way to get residents to fill out census forms, said Salewski.
Potential obstacles to an accurate count include mobile populations, language barriers, lack of access to the
internet, distrust in government and informal living arrangements.
Apartment access is always difficult and risks undercounting of renters, which affects federal funding for
Section 8 housing vouchers and low-income housing tax credits.
Census data also affects funding for health care, education and school lunch programs, as well as highway
construction. The data also has important implications for congressional redistricting.
The Legislature approved $1.6 million this year for census work, but Salewski said it’s difficult to isolate a
cost for Hennepin County alone.
Many of the county’s 9,100 employees — including those in service centers, libraries and other county
buildings — will be trained to assist people with the census. Toward that end, the county has formed

partnerships with dozens of public sector and nonprofit groups, including the State Demographer’s Office,
the Minnesota Census Mobilization Partnership and representatives of several minority groups.
At the recent board briefing, a state census official said the bureau is “way behind” in applications for
census jobs. The state needs 7,500 workers, which will take 40,000 applications to fill, said Salewski. The
temporary, part-time jobs pay from $14 to $20 an hour. Applicants should go to mn.gov/admin/2020-
census/work-for.
“These are well-paying jobs and a great way to get involved,” Salewski said.

Walmart is changing its tactics in fighting assessments in Minnesota.
Big-box retailers have mounted widespread legal campaigns to lower their property-tax bills in recent
years, prompting courts to wade into the murky areas of market values and sometimes leaving counties in
Minnesota and across the nation scrambling to cover lost revenue.
In Minnesota, such property-tax disputes — whether from individuals or megacorporations — have
traditionally been waged in tax court, under a legal framework established by state law in 1935.

But in a new legal tactic, Walmart recently has begun to fight property-tax valuations on constitutional
grounds, asserting that the longstanding state law shouldn't apply.
The Bentonville, Ark.-based company filed challenges against at least four Minnesota counties this spring
and summer on grounds that its rights of equal protection and uniformity granted under the 14th
Amendment of the U.S. Constitution have been violated.
Adopted in 1868 as one of the Reconstruction Amendments after the Civil War, the 14th Amendment was
originally crafted to address citizenship rights and equal protection of the laws to former slaves. The equal-
protection clause is one of the most litigated elements of the Constitution, as it limits the actions of state
government officials.
Lawyers for Walmart, the world's largest retailer, have taken their case to Minnesota district courts,
arguing that property assessors in Anoka, Martin, Wabasha and Washington counties "intentionally,"
"willfully" and "systematically" discriminated against it compared to similarly situated properties in the
same taxing district. The disparities led to an "unequal assessment" and overvaluation of its fair-market
value, the retailer argues.

Walmart aims to reach back and contest six years of tax assessments, from 2013 and 2018, rather than
being bound by the 84-year-old state statute, known as Chapter 278, which sets an April 30 deadline to file
petitions and deals only with the current property-tax year.
The cases are in the early stages and outcomes could vary among different district court judges.

A judge in the Winona County case recently ruled against Walmart's constitutional argument, saying in a
Sept. 12 order that Minnesota's Chapter 278 is the "exclusive remedy" for taxpayers to address unequal
assessments, overvalutions and other claims.
"Taxpayers must seek protection of their federal rights by state remedies," Judge Nancy Buytendorp wrote.
A decision by a different judge in Martin County could come any day. Challenges in Washington and
Anoka counties have not yet come before their district courts.
The basis for the fight isn't new. Retailers — including Menards, Target, Lowe's and Home Depot —
routinely challenge tax assessments in communities across Minnesota and in other states where they do
business.
Municipalities, which in many cases have offered retailers tax incentives to bring jobs and commerce to
their communities, tend to incorporate sales and other measures of current business success into their
market valuation. They use property taxes to keep libraries open, plow the snow, repair roads and hire
police officers.
The companies base their legal claims on what has been called a "dark store" comparison, believing their
properties should be valued based on what their brick-and-mortar properties would claim if sold on the
open market. Because the stores have been designed for a specific purpose, they can have little value to
other commercial enterprises when vacated.
The dark-store argument took root in the wake of the Great Recession and has expanded as the rise in e-
commerce has led to closures of once-venerable companies such as Sears, Herberger's, Kmart and Toys 'R'
Us.
In Minnesota, dark-store challenges could lead to a potential loss of $70 million to $80 million a year in
revenue to local and state governments, a Star Tribune analysis found.
Efforts to reduce tax assessments have continued even as businesses experienced significant reductions in
federal taxes from the 2017 tax overhaul.
Nationwide, retailers are using the dark-store strategy to fight property valuations in at least 20 states,
according to a report by City Lab.

Critics of the dark-store valuation approach model — which also has been used by food producers and
manufacturers — said that reductions in retailers' property taxes disproportionately shift the burden onto
homeowners and small businesses.
Walmart's approach in Minnesota seems to be an anomaly. By arguing on constitutional grounds, it seeks
to move the fight out of tax court, which is an executive branch court established by the Minnesota
Legislature to hear only tax-related cases.
Although all tax-court appeals are heard by the Minnesota Supreme Court, only a small number of cases
go to trial each year.
In the Martin County case, as with the other counties, Walmart argues that the assessors have treated the
company in a systematic and arbitrary way that runs afoul of the company's constitutional protections.

In a complaint filed in the Fifth Judicial District, Walmart argued that between 2013 and 2018, its store in
Fairmont faced a market value assessment "250% and 300% more than the average sales price paid or
assessment for any big box store in Minnesota during the pertinent time frame."
The 164,000-square-foot store opened in 2006. In 2018, Walmart paid $428,636 in property taxes to the
county, according to government records.
At an Aug. 2 hearing, the attorney for Martin County argued that the state's Chapter 278 law already meets
the basic standards of due process and allows a fair opportunity for taxpayer challenges.
The law gives individuals and corporations alike the ability "to put the key in the courthouse door," said
Marc Manderscheid, a real estate law specialist with the Minneapolis firm of Briggs, on behalf of Martin
County.

Walmart lawyer Edward Fox, of the Minneapolis firm Bassford Remele, countered: "What they are asking
this court to do is to slam the courthouse door in our face."
Argued Fox: "The tax court has no jurisdiction to consider constitutional claims."
