R ESOLUTION N O. 2019-245
R ESOLUTION APPROVING E ASEMENT P AYMENTS FOR
P EONY L ANE (10015)
WHEREAS, the Peony Lane / Lawndale Lane Extension project was listed in the 2014-2018
Capital Improvement Program at an estimated total cost of $12,800,000; and
WHEREAS, five alternative alignments were developed and analyzed; and
WHEREAS, Alignment 3B was determined to best meet the City’s needs because it has fewer
impacts to private property; it requires fewer relocations; it is slightly better for future land use
opportunities and it is less expensive due to lower right of way costs; and
WHEREAS, final plans have been developed and permanent and temporary easement needs
have been identified; and
WHEREAS, appraisals have been prepared by an independent appraiser and offers were
authorized by the City Council on November 12, 2013; and
WHEREAS, some offers were accepted, some negotiated and settled and some properties were
subject to condemnation; and
WHEREAS, Parcel 21 (Baer) settled in January, 2016 and is the subject of an Order on Motion for
Attorney’s Fees; and
WHEREAS, in 2018 Baer and the City determined existing public infrastructure was located in an
area which was not part of the settlement in January 2016.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA:
1. Payment of $14,643.37 for 3,609 square feet easement adjacent to Peony Lane, City
Project No. 10015 as identified in attached easement agreement is approved.
2. Payment of $1,000.00 for allowance of fill materials to remain on Baer property
adjacent to Peony Lane as identified in the attached agreement is approved.
3. The Mayor and City Manager are authorized to sign necessary documents and
Administrative Services Director is authorized to process payment of such.
