R ESOLUTION A PPROVING E NCROACHMENT A GREEMENT FOR A D RIVEWAY WITHIN THE
D RAINAGE AND U TILITY E ASEMENTS ON THE P ROPERTY
LOCATED AT 18120 48 TH A VENUE N ORTH
WHEREAS, Christopher P Casuscelli and Jennifer M Donato, property owners, have requested
the City to approve an encroachment agreement allowing the construction of a driveway within
drainage and utility easements at 18120 48th Avenue North; and
WHEREAS, the encroachment agreement permits only the driveway within the easements and
all related facilities must still meet all applicable City codes; and
WHEREAS, the owner’s properties are legally described as: Lot 5 Block 4 Plum Tree 3rd Addition.
NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that the encroachment agreement which will allow a driveway in the drainage and utility
easements at 18120 48th Avenue North is approved.
APPROVED by the City Council on this 10th day of September, 2019.
