HomeMy WebLinkAboutCity Council Resolution 2019-236 C ITY OF P LYMOUTH R ESOLUTION N O. 2019-236 R ESOLUTION A PPROVING C ONDITIONAL U SE P ERMIT AND V ARIANCES FOR R OBBINSDALE S CHOOL D ISTRICT (ISD 281) AT A RMSTRONG TH H IGH S CHOOL, 10635 36 A VENUE (2019 045) WHEREAS, Robbinsdale Area Schools (ISD #281) has requested approval of the following items th for Armstrong High School located at 10635 36 Avenue: 1) conditional use permit to allow a scoreboard with video display panels; 2) variance to allow a 19-foot tall softball scoreboard where 16 feet is allowed; and 3) variance to allow the baseball scoreboard to remain at 250 square feet where 150 square feet is allowed for the property legally described as follows: The West Half of the Northeast Quarter of the Northwest Quarter of Section 24, Township 118, Range 22, Hennepin County, Minnesota, except that part of the North 275 feet thereof lying East of the West 90 feet thereof. And All that part of Government Lot 1, Section 24, Township 118, Range 22, Hennepin County, Minnesota, lying north of the westerly extension of the North line of the Southeast Quarter of the Northwest Quarter thereof, expect the North 435 feet thereof, and except the West 416 feet of the North 735 feet of said Government Lot 1, Section 24, Township 118, Range 22, according to the Government Survey thereof. And The North Half of the East Half of the Northeast Quarter of the Northwest Quarter of Section 24, Township 118, Range 22, Hennepin County, Minnesota, according to the Government Survey thereof. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and does approve the request by Robbinsdale Area Schools for a conditional use permit to install a scoreboard at the outdoor stadium; a variance to allow a 19-foot tall softball scoreboard and a variance to allow the baseball scoreboard to remain at 250 square feet for property th located at 10635 36 Avenue, subject to the following conditions: 1. A conditional use permit is approved to allow a scoreboard with no more than 610 square feet in area, no more than 33 feet in height, and a video display panel, in accordance with the application and plans received by the City on June 5, 2019, with additional information on June 25, 2019, except as may be amended by this resolution. The requested variance is approved to allow a 19-foot tall softball scoreboard where 16 feet is allowed, in accordance with the application received by the City on July 25, 2019, except as may be amended by this resolution. 3. The requested variance is approved to allow a 250-square foot baseball scoreboard where 150 square feet is allowed, in accordance with the application received by the City on July 29, 2019, except as may be amended by this resolution. 4. The conditional use permit is approved with the finding that all applicable general and specific conditional use permit standards are met. 5. Prior to installation, the applicant shall obtain all necessary building permits. 6. The footing and foundation shall be designed by a Minnesota-licensed structural engineer. 7. The information displayed within the scoreboard shall be regulated by Section 21650 of the zoning ordinance. 8. The permit is subject to all applicable building and fire codes, and to all city regulations and ordinances. Any violation thereof shall be grounds for revocation. 9. Subsequent phases or expansions are subject to required reviews and approvals per ordinance provisions. 10. This approval shall expire one year after the date of approval, unless the property owner or applicant has started the project, or unless the landowner or applicant has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 21015.07 of the zoning ordinance.
