HomeMy WebLinkAboutCity Council Resolution 2019-233 C ITY OF P LYMOUTH R ESOLUTION N O. 2019-233 R ESOLUTION A PPROVING C ONVEYANCE OF R EAL P ROPERTY AND D ISPENSING WITH S TATUTORY R EQUIREMENTS FOR R EVIEW BY P LANNING C OMMISSION OF D ISPOSAL OF R EAL P ROPERTY WHEREAS, the City of Plymouth (“City”) owns property legally described as: That part of Outlot B, Gleanloch Second Addition, Hennepin County, Minnesota described as beginning at the southwest corner of Lot 1, Block 4, said Gleanloch Second Addition; thence North 89 degrees 39 minutes 33 seconds East, said Gleanloch Second Addition bearing system, along the north line of said Outlot B to the northeast corner of the West 942.94 feet of said Outlot B; thence South 0 degrees 12 minutes 51 seconds East along the east line of said West 942.94 feet to the south line of said Outlot B; thence South 89 degrees 39 minutes 33 seconds West along said south line to the intersection with a line bearing South 0 degrees 20 minutes 27 seconds East from the point of beginning; thence North 0 degrees 20 minutes 27 seconds West to the point of beginning. (“Subject Property”); and WHEREAS, pursuant to Resolution No. 88-444, the City intended to transfer title of the Subject Property to the owner of adjacent property legally described as: Outlot B, except the West 924.94 feet thereof, Gleanloch Second Addition, Hennepin County, Minnesota. “Benefitted Property”); and WHEREAS, the Benefitted Property is now owned by Tracy B. Vining and Bradley D. Vining (hereinafter referred to as Owners); and WHEREAS, Minn. Stat. §462.356, subd. 2 requires that the Planning Commission review the City's proposed disposal of real property for compliance with the comprehensive plan and to report to the City Council in writing its findings; and WHEREAS, Minn. Stat. §462.356, subd. 2 provides for an exception from the requirement for review by the Planning Commission upon 2/3 vote of the City Council dispensing with the requirement and finding that the disposal of the real property has no relationship to the comprehensive municipal plan; and WHEREAS, before the City may dispose of real property, the City Charter requires the City to hold a public hearing for the proposed disposition preceded by 10 days' published notice; and WHEREAS, ten days published notice of the hearing was given and the City Council has conducted a public hearing on July 23, 2019, at which all persons desiring to be heard were given an opportunity to be heard on the disposition of the Subject Property. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: Resolution No. 2019-233 Page 2 of 2 1. The City Council finds that the disposal of the Subject Property to Tracy B. Vining and Bradley D. Vining has no relationship to the comprehensive municipal plan. Review by the Planning Commission of the disposal of the Subject Property is hereby dispensed with. 2. Conveyance of the Subject Property to Tracy B. Vining and Bradley D. Vining by quit claim deed is hereby approved conditioned upon: (a) Owners executing a lot combination request to the County for combining the Subject Property with the Benefitted Property which request shall be submitted to Hennepin County simultaneously with the recording of the deed to the Subject Property; (b) the Subject Property shall not be subdivided in the future in order to create additional lots; and (c) Owners paying all costs and fees associated with this conveyance. 3. The Mayor and City Manager are authorized and directed to execute all documents, and take all appropriate measures to dispose of the Subject Property accordingly.
