RESOLUTION No. 2013-121
A RESOLUTION APPROVING A CONDITIONAL USE PERMIT TO ALLOW A TRADE/ COSMETOLOGY
SCHOOL FOR PCI ACADEMY FOR PROPERTY LOCATED AT 4315 PEONY LANE (2013021)
WHEREAS, Studio M Architects has requested approval of a conditional use permit for the site
legally described as follows:
Lot 4, Block 1, Peony Promenade, Hennepin County, Minnesota.
WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing
and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY COUNCIL
OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the
request by PCI Academy for a conditional use permit to allow a trade school use in the existing
retail building located at 4315, subject to the following conditions:
1. A conditional use permit is approved to allow a 6,000 -square foot trade school facility for
the PCI Academy, in accordance with the application and plans received by the city on
March 21, 2013, except as may be amended by this resolution.
2. Approval of the conditional use permit is contingent on approval of the zoning ordinance
text amendment to allow trade schools in the C-3, highway commercial zoning district by
conditional use permit.
3. The conditional use permit is approved with the finding that all applicable conditional use
permit standards are met.
4. Prior to construction of tenant improvements in the building, the applicant must obtain
separate approval of a building permit.
5. The permit is subject to all applicable building and fire codes, and to all city regulations and
ordinances. Any violation thereof shall be grounds for revocation.

6. Standard Conditions:
a. Any signage shall comply with the city's sign regulations.
b. All waste and waste containers shall be stored within approved designated areas.
c. All parking shall be off-street in designated areas which comply with the zoning
ordinance.
d. Subsequent phases or expansions are subject to required reviews and approvals per
ordinance provisions.
e. This approval shall expire one year after the date of approval, unless the property owner
or applicant has started the project, or unless the applicant, with the consent of the
property owner, has received prior approval from the city to extend the expiration date
for up to one additional year, as regulated under section 21015.07 of the zoning
ordinance.
