RESOLUTION No. 2013-117
A RESOLUTION APPROVING A FINAL PLAT AND DEVELOPMENT CONTRACT FOR HANSON
COMPANIES, LLC. AND GWS LAND DEVELOPMENT OF PLYMOUTH, LLC. FOR "WOOD
CREST HILLS" FOR PROPERTY LOCATED AT 5825, 5875, AND 5925 VICKSBURG LANE
NORTH (2013017)
WHEREAS, Hanson Companies, LLC. and GWS Land Development of Plymouth, LLC have
requested approval of a final plat for 32 new single-family lots and one outlot on the roughly 20 -
acre parcel presently legally described as follows:
The north 300 feet of the south 930 feet of the east 759 feet of the northeast quarter of
Section 05, Township 118, Range 22, Hennepin County, Minnesota. And
The north 300 feet of the south 630 feet of the east 759 feet of the northeast quarter of
Section 05, Township 118, Range 22, Hennepin County, Minnesota. And
The north 300 feet of the south 330 feet of the east 759 feet of the northeast quarter of
Section 05, Township 118, Range 22, Hennepin County, Minnesota. And
Outlot B, Terra Vista 2"a Addition.
WHEREAS, city staff has prepared a development contract covering the improvements related to
said plat.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY COUNCIL
OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the
request by Hanson Companies, LLC. and GWS Land Development of Plymouth, LLC. for a final
plat for "Wood Crest Hills"; and
FURTHER, that the development contract for said plat be approved, and that upon prior
execution of the development contract by the developer, the mayor and city manager be
authorized to execute the development contract on behalf of the city; and
FUTHER, that the following conditions be met prior to recording of, and related to said plat:
1. The final plat for Wood Crest Hills is approved in accordance with the plans received by the
city on March 14, 2013, except as may be amended by this resolution.
2. This final plat includes and acknowledges the variance for reduced lot width for Lot 7, Block
2 approved with the preliminary plat. No other variances are granted or implied.

3. Prior to recording the final plat, the applicant shall: 1) remove the home at 5825 Vicksburg
Lane; 2) pay the park dedication cash fee; 3) receive City approval of final constriction plans;
and 4) execute a development contract and submit related financial guarantees and fees.
4. Prior to recording the final plat, the applicant shall fiilfill the requirements, submit the
required information, and revise the plans as indicated below, consistent with applicable city
code or zoning ordinance requirements:
a. Provide HOA documents for the development that include language addressing the
following: 1) prohibition of strictures and vegetation clearing in the wetland buffers and
2) maintenance for common elements including buffer monuments, median plantings,
mailboxes, monument signs, shared retaining walls, sidewalks, etc.
b. Execute an encroachment agreement for retaining walls that are constricted within
drainage and utility easements on Lots 4-6, Block 1; Lots 6-10, Block 2; and Lots 9 and
10, Block 3.
c. Add/relocate wetland buffer monuments as required by section 21670 of the zoning
ordinance.
5. Prior to the issuance of a building permit, the applicant shall submit a survey indicating:
a. A minimum of two front yard trees to be preserved or planted, and
b. Silt fence and tree preservation fencing installed consistent with city code.
6. Prior to or in conjunction with the third phase of this development, the watermain shall
be connected to fiiture watermain in Dunkirk Lane or Vicksburg Lane.
7. When fiirther subdivision or development of Lots 14 or 15, Block 3 occurs, all proposed lots
and/or buildings shall be served with city sewer and water and shall be subject to area
assessments for sewer and water and park dedication fees. At that time, private wells and on-
site sanitary systems must be capped or abandoned in accordance with state and county
regulations.
8. Standard Conditions:
a. No building permits shall be issued until the final plat, agreements, and easements are filed
and recorded with Hennepin County and proof of recording is submitted to the city.
b. Compliance with the city's tree preservation regulations.
c. Tree preservation and silt fencing shall be maintained throughout constriction.
d. No trees shall be planted in the boulevard.
e. Removal of all hazardous trees from the property at the owner's expense.
f. Any signage shall require separate permits and shall comply with the city's signage
regulations.
g. This approval shall expire two years after the date of approval, unless the property owner
or applicant has recorded the final plat, or unless the applicant, with the consent of the

property owner, has received prior approval from the city to extend the expiration date for
up to one additional year, as regulated under section 512 of city code.
