HomeMy WebLinkAboutCity Council Resolution 2019-222 C ITY OF P LYMOUTH R ESOLUTION N O. 2019-222 R ESOLUTION A PPROVING A PPLICATION TO THE M INNESOTA D EPARTMENT OF E MPLOYMENT AND E CONOMIC D EVELOPMENT (DEED) R EDEVELOPMENT G RANT P ROGRAM WHEREAS, the City of Plymouth has received a request from Dominium Acquisition, LLC for the City of Plymouth to submit a Redevelopment Grant Application (the “Application”) to the Department of Employment and Economic Development (“DEED”) on August 1, 2019, for the redevelopment and environmental cleanup (the “Project”), as identified in the Application, of the former Four Seasons property located at 4108 Lancaster Lane North (the “Property”); and WHEREAS, DEED requires a resolution approving the Application from the governing body of the municipality where the Property is located. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA that the City of Plymouth act as the legal sponsor for the Project contained in the Application to be submitted on August 1, 2019 and that the City Manager is authorized to execute such agreements as are necessary to implement the Project on behalf of the City of Plymouth. BE IT FURTHER RESOLVED that the City of Plymouth has the legal authority to apply for financial assistance, and the institutional, managerial, and financial capability to ensure adequate project administration. BE IT FURTHER RESOLVED that the sources and amounts of the local match identified in the application ARE COMMITTED to the Project. BE IT FURTHER RESOLVED that if the Project fails to substantially provide the public benefits listed in the application within five years from the date of the grant award, the City of Plymouth may be required to repay 100 percent of the awarded grant per Minn. Stat. § 116J.575 Subd. 4. BE IT FURTHER RESOLVED that the City of Plymouth has not violated any Federal, State or local laws pertaining to fraud, bribery, graft, kickbacks, collusion, conflict of interest or other unlawful or corrupt practice. BE IT FURTHER RESOLVED that upon approval of its application by the state, the City of Plymouth may enter into an agreement with the State of Minnesota for the Project, and that the City of Plymouth certifies that it will comply with all applicable laws and regulation as stated in all contract agreements.
