HomeMy WebLinkAboutCity Council Resolution 2019-219 C ITY OF P LYMOUTH R ESOLUTION N O. 2019-219 R ESOLUTION D ISPENSING WITH S TATUTORY R EQUIREMENTS FOR R EVIEW BY P LANNING C OMMISSION AND D ISPOSING OF R EAL P ROPERTY WHEREAS, the City of Plymouth (“City”) is proposing to dispose of property legally described as follows: That part of the East 660 feet of the North 1/2 of the Northeast Quarter of Section 8, Township 118, Range 22, lying Northerly of a line 30 feet Northerly of, measured. radial to and parallel with the Northerly right of way line of the Soo Line Railroad (Minneapolis, St. Paul & Sault Ste. Marie Railroad Company), Hennepin County, Minnesota. EXCEPT: that part which lies westerly and northerly of the following described line: Commencing at the Northeast Quarter of Section 8; thence westerly, along the north line of said North 1/2 a distance of 372.93 feet to the point of beginning of said line; thence deflecting to the left 68°07'29" a distance of 230.37 feet; thence deflecting to the right. 57°25'15" a distance of 202.55 feet to the West line of said East 660 feet, and said line there terminating. (“Subject Property”) by transferring fee title to the Subject Property to R & R Construction of Minneapolis, Inc. (“Buyers”); and WHEREAS, the City Council finds that it has no use for the Subject Property, which is a vacant lot and that the conveyance of the Subject Property to Buyers is in the best interest of the City; and WHEREAS, Minn. Stat. §462.356, subd. 2 requires that the Planning Commission review the City's proposed disposal of real property for compliance with the comprehensive plan and to report to the City Council in writing its findings; and WHEREAS, Minn. Stat. §462.356, subd. 2 provides for an exception from the requirement for review by the Planning Commission upon 2/3 vote of the City Council dispensing with the requirement and finding that the disposal of the real property has no relationship to the comprehensive municipal plan; and WHEREAS, before the City may dispose of real property, the City Charter requires the City to hold a public hearing for the proposed disposition preceded by 10 days' published notice; and WHEREAS, ten days published notice of the hearing was given and the City Council has conducted a public hearing on July 23, 2019, at which all persons desiring to be heard were given an opportunity to be heard on the disposition of the Subject Property. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1 1. The conveyance of the Subject Property has no relationship to the comprehensive municipal plan. Review by the Planning Commission of the conveyance of the Property is hereby dispensed with. 2. Conveyance of the Subject Property to the Buyers pursuant to the terms of the attached Purchase Agreement is hereby approved. 3. The Mayor and City Manager are authorized and directed to execute all documents, and take all appropriate measures to convey the Subject Property to Buyers.
