HomeMy WebLinkAboutCity Council Resolution 2019-207 C ITY OF P LYMOUTH R ESOLUTION N O. 2019-207 R ESOLUTION A PPROVING C ONDITIONAL U SE P ERMIT A MENDMENT P ERTAINING TO U SE OF THE O UTDOOR S TADIUM AT A RMSTRONG TH H IGH S CHOOL, 10635 36 A VENUE (2019 040) WHEREAS, Robbinsdale Area Schools (ISD #281) has requested approval of a conditional use permit amendment to address Minnesota State High School League (MSHSL)-sanctioned events and non-school events at the outdoor stadium at Armstrong High School; and WHEREAS, the property is legally described as follows: The West Half of the Northeast Quarter of the Northwest Quarter of Section 24, Township 118, Range 22, Hennepin County, Minnesota, except that part of the North 275 feet thereof lying East of the West 90 feet thereof. And All that part of Government Lot 1, Section 24, Township 118, Range 22, Hennepin County, Minnesota, lying north of the westerly extension of the North line of the Southeast Quarter of the Northwest Quarter thereof, expect the North 435 feet thereof, and except the West 416 feet of the North 735 feet of said Government Lot 1, Section 24, Township 118, Range 22, according to the Government Survey thereof. And The North Half of the East Half of the Northeast Quarter of the Northwest Quarter of Section 24, Township 118, Range 22, Hennepin County, Minnesota, according to the Government Survey thereof. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and does approve the request by Robbinsdale Area Schools for a conditional use permit amendment to address MSHSL-sanctioned events and non-school events at the outdoor th stadium for property located at 10635 36 Avenue, subject to the following conditions: 1. The requested conditional use permit amendment allows expanded use of the stadium for MSHSL events and non-school events, and limits use of the stadium public address system and lighting for non-school events, in accordance with the application received by the City on May 13, 2019, except as may be amended by this resolution. The requested conditional use permit amendment is approved with the findings that all applicable conditional use permit standards would be met, as outlined in the zoning ordinance. 3. Except as amended herein, all other applicable conditions of Resolution 2006-170 shall remain in effect. 4. The stadium may be used for MSHSL-sanctioned events and for non-school events at times the stadium is not being used for school events, subject to the conditions contained within this resolution. 5. The stadium public address system may be used for MSHSL events, and may be used up to eight days per year to accommodate non-school events. Such use of the stadium public address system for non-school events shall be limited to eight Saturdays, between June 1 and August 15, from 11:00 a.m. to 5:00 p.m. In no case shall renters provide or use their own public address system. 6. MSHSL-sanctioned events at the stadium shall end by 9:30 p.m., with stadium lighting to be turned off within 30 minutes after completion of the event. Non-school events at the stadium shall end by 9:00 p.m. and the stadium lighting shall be turned off by 9:00 p.m. 7. Parking for MSHSL-sanctioned events and non-school events shall be restricted to the lower student lot located north of the stadium and tennis courts. 8. A stadium manager employed by the school district shall be on-site during all MSHSL events and during all non-school events held in the outdoor stadium. 9. Rental contracts for use of the outdoor stadium shall prohibit the use of tobacco and alcohol on the site. 10. Prior to implementation of this conditional use permit amendment, the applicant shall provide an updated Safety and Security Plan for the campus, to be reviewed and approved by the Plymouth Public Safety Department. 11. Standard Conditions: a. Any subsequent phases, expansions, or changes are subject to required reviews and approvals per ordinance provisions. b. The conditional use permit amendment shall expire one year after the date of approval, unless the property owner has initiated the use (including providing the required updated Safety and Security Plan), or unless the property owner has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 21015.07 of the zoning ordinance.
