HomeMy WebLinkAboutCity Council Resolution 2019-193 C ITY OF P LYMOUTH R ESOLUTION N O. 2019-193 R ESOLUTION A PPROVING C ONDITIONAL U SE P ERMITS FOR D ORSEY & W HITNEY LLP FOR F OURTH B APTIST C HURCH FOR P ROPERTY LOCATED AT 900 F ORESTVIEW L ANE (2019035) WHEREAS, Dorsey & Whitney LLP, has requested approval of conditional use permits to allow the installation of an FM transmitting antenna 60 feet above grade on the Fourth Baptist Church for the property legally described as follows: Lot 1, Block 1, Fourth Baptist Church Addition, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and does approve the request by Dorsey & Whitney LLP for conditional use permits to allow the installation of an FM transmitting antenna 60 feet above grade on the Fourth Baptist Church located at 900 Forestview Lane, subject to the following conditions: 1. A conditional use permit is approved to allow the installation of an FM transmitting antenna on the steeple of Fourth Baptist Church, in accordance with the application and plans received by the City on May 6, 2019, except as may be amended by this resolution. 2. A conditional use permit is approved to allow the installation of an antenna mounted to an existing structure 60 feet above grade, in accordance with the application and plans received by the City on May 6, 2019, except as may be amended by this resolution. 3. The conditional use permits are approved with the finding that all applicable conditional use permit standards are met. 4. The antenna mounting brackets, and any visible appurtenances shall be galvanized or painted to match the building. 5. Prior to commencement of the project, the applicant shall: 1) submit an acceptable structural analysis, from a licensed structural engineer, demonstrating proper installation, weight and wind load capacity; and 2) obtain any necessary permits from the Federal Communications Commission (FCC). 6. The conditional use permits are subject to all applicable building and fire codes, and to all City regulations and ordinances. Any violation thereof shall be grounds for revocation. Res. 2019-193 File 2019035 Page 2 7. Standard conditions: a. Any subsequent phases or expansions are subject to required reviews and approvals per ordinance provisions. b. The conditional use permit shall expire one year after the date of approval, unless the property owner or applicant has started the project, or unless the applicant, with the consent of the property owner, has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under section 21015.07 of the zoning ordinance.
