HomeMy WebLinkAboutCity Council Resolution 2019-152 C ITY OF P LYMOUTH R ESOLUTION N O. 2019-152 R ESOLUTION A PPROVING A P RELIMINARY P LAT FOR S ATHRE-B ERGQUIST, I NC., FOR “R AWSON A DDITION” FOR P ROPERTY TH L OCATED AT 18300 8 A VENUE N ORTH (2018076) WHEREAS, Sathre-Bergquist, Inc., has requested approval of a preliminary plat for roughly 7.34 acres of land presently legally described as follows: The North 654.6 feet of the East 240 feet of the Southeast Quarter of the Northwest Quarter of Section 31, Township 118, Range 22. That Tract described as: Commencing at the Northwest corner of the Southwest Quarter of the Northeast Quarter of Section 31, Township 118, Range22: thence Easterly along the North line of said Southwest Quarter of the Northeast Quarter, 256.4 feet; thence Southerly 652.8 feet to a point which is 241.67 feet East of the West line of said Southwest Quarter of the Northeast Quarter; thence Westerly 241.67 feet to said West line of said Southwest Quarter of the Northeast Quarter; thence Northerly along said line 654.6 feet to point of beginning, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Sathre-Bergquist, Inc. for a preliminary plat for Rawson Addition, subject to the following conditions: 1. A preliminary plat is approved for two single-family lots in accordance with the development plans received by the city on October 17, 2018, and additional information on January 31, 2019 and March 7, 2019, except as amended by this resolution. 2. Approval of the preliminary plat is contingent upon City Council approval of the rezoning of the site from FRD to RSF-1. 3. Prior to commencement of site development including grading operations, the developer shall: a) Install and request inspection of tree protection fencing and silt fencing. b) Obtain the necessary right-of-way permits from the City of Plymouth Engineering Division to th allow work in the 8 Avenue right-of-way. c) Obtain NPDES (National Pollutant Discharge Elimination System) permit if required. 4. Prior to recording the final plat, the developer shall: a) Receive city approval of final construction plans. b) Execute a site improvement performance agreement and submit a financial guarantee pursuant to section 21045.10 of the zoning ordinance. c) Pay the park dedication cash fee in lieu of land dedication for two dwelling units, in accordance with the dedication ordinance in effect at the time of filing of the final plat, giving credit in the Res. 2019-152 File 2018076 Page 2 fee for the square footage of the trail. In addition, the Park Department will provide trail signage and future maintenance of the trail. d) Revise the plans to: th i. Show the water service connection to the water main in 8 Avenue and not to the hydrant lead as currently shown. ii. Show the sanitary sewer service to the sanitary main north of the manhole in the street or boulevard. iii. Revise the existing sanitary sewer utility easement width from 20 feet (10 feet on each side of the pipe) to 50 feet (25 feet on each side of the pipe) in order to allow for future maintenance of the pipe. In the area where there is not 25 feet to the east from the existing pipe to the east side of the property, the width of the easement shall be to the eastern property line. iv. Include a 10-foot wide trail easement along the southern boundary of the site for the th purposes of the construction of a future sidewalk along 8 Avenue. th v. Include an eight-foot wide trail easement running north and south from 8 Avenue to the city-owned open space north of the subject property within the sanitary sewer easement until the trail turns west. At that point, the trail easement shall follow the edge of the hill east the sewer easement in a mutually agreeable location. vi. Utilize the buffer averaging allowance in order to move any wetland buffer away from the existing home. vii. Identify the wetland buffer monument locations pursuant to zoning ordinance requirements, including around the existing home. 5. Prior to the issuance of a building permit, the developer shall: a) Install permanent wetland buffer monument signs pursuant to ordinance requirements. b) Provide a certificate of survey indicating a minimum of two front yard trees to be preserved or planted on the new lot. c) The lowest floor elevation shall be at least two feet higher than the high water elevation for the wetland or pond. 6. Standard Conditions: a. No building permits, shall be issued until the final plat is filed and recorded with Hennepin County. b. Development standards and setbacks for this plat shall comply with the RSF-1 zoning standards. No variances are granted or implied. c. Any signage shall require separate permits and shall comply with the city’s sign regulations. d. Removal of all hazardous trees at the owner's expense. e. No trees shall be planted in the boulevard. f. This approval shall expire one year after the date of approval, unless the property owner or applicant has applied for final plat approval, or unless the applicant, with the consent of the landowner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 512 of city code. th APPROVED by the Plymouth City Council this 14 day of May, 2019.
