HomeMy WebLinkAboutCity Council Resolution 2019-123 C ITY OF P LYMOUTH R ESOLUTION N O. 2019-123 R ESOLUTION A PPROVING A C ONDITIONAL U SE P ERMIT FOR AN A TTACHED G ARAGE THAT WOULD EXCEED 1,000 SQUARE FEET IN F LOOR A REA FOR P ROPERTY LOCATED AT 1615 T ROY L ANE (2019 018) WHEREAS, Kai and Sharon Kroll have requested approval of a conditional use permit to allow an addition to their existing attached garage that would result in a total attached garage space that exceeds 1,000 square feet; and WHEREAS, the property is legally described as Tract F, Registered Land Survey No. 854, files of Registrar of Titles, Hennepin County, Minnesota; and WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and does approve the request by Kai and Sharon Kroll for a conditional use permit for an attached garage that would exceed 1,000 square feet in floor area for the property located at 1615 Troy Lane, subject to the following conditions: 1. The requested conditional use permit is approved to allow 1,431 square feet of attached garage space on the subject property, in accordance with the plans received by the City on March 22, 2019, except as may be amended by this resolution. 2. A separate building permit is required prior to the commencement of the project. 3. Prior to issuance of the building permit, the applicant shall: a. Revise the survey to include the property address and all easements. b. Install a double row of silt fence around the construction area, as indicated by staff, to protect the lake until disturbed soil is stabilized and turf is established. 4. The requested conditional use permit is approved with the findings that all applicable conditional use permit standards would be met as outlined in the zoning ordinance. 5. Standard Conditions: a. Any subsequent phases or expansions are subject to required reviews and approvals per ordinance provisions. b. The conditional use permit shall expire one year after the date of approval, unless the property owner or applicant has started the project, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 21015.07 of the zoning ordinance.
