R ESOLUTION A PPROVING A R EQUEST TO D ENY A CCESS TO 22 ND A VENUE N ORTH
FOR A LAN G ABRIELE FOR P ROPERTY LOCATED AT
15960 22 ND P LACE N ORTH (2019022)
WHEREAS, Alan Gabriele has requested that access to 22nd Avenue North be denied for his
property located at 15960 22nd Place North legally described as:
Lot 1, Block 1, Steeplechase 5th Addition, according to the recorded plat thereof, Hennepin
County, Minnesota.
WHEREAS, the property is a triple-frontage lot abutting 22nd Place North, 22nd Avenue North and
Vicksburg Lane; and,
WHEREAS, the Steeplechase 5th Addition was approved in 1988 and the City has no record if
access to 22nd Avenue North was denied;
WHEREAS, 22nd Avenue North is a minor collector and such accesses are discouraged by the
Comprehensive Plan and the City Code;
WHEREAS, 22nd Avenue North is a minor collector roadway and without this action the yard
between the home and 22nd Avenue North may not be considered an equivalent rear yard; and,
WHEREAS, the City has fence setbacks that are greater if access to 22nd Avenue North is
permitted and the applicant would like to construct a five-foot fence up to the right-of-way for 22nd
Avenue North; and,
WHEREAS, the proposed fence would be located outside the site visibility triangle for 22nd Place
North and 22nd Avenue North.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should and does deny private driveway access to 22nd Avenue North from 15960
22nd Place North.
