HomeMy WebLinkAboutCity Council Resolution 2019-059 CITY OF PLYMOUTH RESOLUTION NO. 2019-059 R ESOLUTION A PPROVING F INDINGS OF F ACT FOR THE R EZONING OF L AND LOCATED AT THE S OUTHEAST C ORNER OF C OUNTY R OADS 47 AND 101 (2018 078) WHEREAS, West Plymouth Development, Inc. has requested reclassification of the zoning from FRD (future restricted development) to PUD (planned unit development) for roughly 75 acres located southeast of County Roads 47 and 101; and WHEREAS, the affected property to be rezoned to PUD is presently legally described as follows: That part of the Northwest Quarter of the Northwest Quarter of Section 6, Township 118, Range 22, Hennepin County, Minnesota described as follows: Commencing at the Southwest corner of said Northwest Quarter of the Northwest Quarter; thence on an assumed bearing of North 89 degrees 52 minutes 54 seconds East, along the South line of said Northwest Quarter of the Northwest Quarter, a distance of 394.51 feet to the point of beginning; thence continue North 89 degrees 52 minutes 54 seconds East; along said South line, a distance of 120.40 feet; thence North 21 degrees 38 minutes 37 seconds West, a distance of 109.52 feet; thence South 68 degrees 21 minutes 23 seconds West, a distance of 112.00 feet to a line that bears North 21 degrees 38 minutes 37 seconds West from the point of beginning; thence South 21 degrees 38 minutes 37 seconds East, a distance of 65.31 feet to the point of beginning. AND The West 750.00 feet of the Southwest Quarter of the Northwest Quarter of Section 6, Township 118, Range 22, Hennepin County, Minnesota. AND Resolution 2019-059 (2018078) Page 3 All that part of the West One-Half of the Northwest Quarter of Section 6, Township 118, Range 22, in Hennepin County, Minnesota, lying South of County Road No. 47, except: That part of the West Half of the Northwest Quarter of Section 6, Township 118, Range 22, lying Southerly of the following described line: Commencing at the Northwest corner of the Southwest Quarter of the of the Northwest Quarter of said section 6 thence on an assumed bearing of North 0 degrees 44 minutes 04 seconds West, along the West line of said Section6, , a distance of 500 feet, to the point of beginning of the line to be described; thence North 89 degrees 15 minutes 56 seconds East, 470.00 feet; thence South 39 degrees 05 minutes 06 seconds East 1214.27 feet, to the East line of the West Half of the Northeast Quarter of said Section 6 and said line there terminating. AND The West 275 feet of the Northerly 1120.2 feet of the Northeast Quarter of the Northwest Quarter lying South of County Road No. 47, Section 6, Township 118, Range 22, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval; and WHEREAS, the City Council has adopted an ordinance rezoning the affected land from FRD to PUD. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and does approve the request for reclassification of the zoning from FRD to PUD for roughly 75 acres as legally described above, based on the following findings: 1. The PUD zoning would be consistent with the LA-2 guiding shown under the draft 2040 comprehensive plan. 2. The proposed single-family land use and density would be consistent with LA-2 guiding of the site. 3. The proposed single-family development plan and lot arrangement would comply with the requested PUD. 4. Adequate infrastructure would be available to support the proposed development.
