ACTION REQUESTED: Staff will be presenting an overview of County roadways which have needs but are not currently programmed in the County’s five year plan. The majority of the presentation will focus on the County Road 47 corridor including public engagement tools and corridor study schedule. Staff wants to confirm priorities of the Council as staff submits future capital improvement program requests to the County. 2. BACKGROUND: The City identified seven projects under Hennepin County jurisdiction where improvements or additional study may be necessary to better align with City priorities. The PowerPoint presentation will cover seven of these projects, of which one is currently in queue for construction: 1) CSAH 9/494 Interchange Project – In queue for construction in 2019 2) County Road 47 Corridor – Corridor study in progress in 2019 3) CSAH 61/CSAH 6 Intersection 4) CSAH 101 south of CSAH 6 5) CSAH 6 west of CSAH 101 6) CSAH 24 west of CSAH 101 7) CSAH 73 Realignment south of Hwy 55 Also of note is the CSAH 6 retaining wall replacement project which is not on the list because of its recent completion in 2018. The City led this project through design, bidding, and inspection and the County fully reimbursed the City for associated costs. Staff understands the top priority is CSAH 9/494 which is being delivered in 2019 with a scheduled bid date in mid-April with construction slated to start in May 2019. The project would be completed by the end of 2019. The County Road 47 corridor is the City’s next highest priority on the County system. Currently there is no funding identified for County Road 47, however, the City has discussed a potential turnback with the County which could include the City accepting County Road 47 and a portion of CSAH 101 from the County, and the County accepting Peony/Lawndale from the City. There was Page 1 never agreement between the City and County on the City’s proposal and draft agreement, included in the attachment, from the November 29, 2016 Special Council meeting packet. Through this work session staff wants to affirm the Council’s top priority is now the County Road 47 corridor given the CSAH 9/494 Interchange Project is moving ahead for 2019 construction. Also, in addition to County Road 47, does the Council have interest in exploring any of the following projects for further analysis? 3) CSAH 61/CSAH 6 Intersection 4) CSAH 101 south of CSAH 6 5) CSAH 6 west of CSAH 101 6) CSAH 24 west of CSAH 101 7) CSAH 73 Realignment south of Hwy 55 A majority of the presentation will focus on the County Road 47 Corridor Study. I live off of the 47/Dunkirk turn-almost rear ended many times I don't drive on this road regularly, but given the crazy amount of development in that part of the city, the road as constructed does not likely serve the drastically increased volume of traffic. This road is extremely dangerous as there are people bicycling and elderly drivers are found on the wrong side of the road. Also it is an area where there is a high incidence of tailgating and speedi Going northbound on Vicksburg and taking a left on 47 is narrow. Make the shoulder on 47 wider. I probably use this road once a year, I’m probably not the best to answer this. 1. Increase lanes. 2. Left/right turn lanes into neighborhoods. The slope on Yucca Lane N. which leads up to CR 47 needs to be addressed. It is just steep enough that when there is ice or snow, cars struggle to get up it and onto CR 47 or cannot safely do so. A special consideration for the Elm Creek Meadows Townhome Development and the ability of the residents who bike/walk/jog to the Northwest Greenway via the Plymouth Dog Park or south on Lawndale. Trying to cross the street at the crosswalk by the park next to Lake Camelot is extremely dangerous. I'm surprised people have not been hit yet as people drive too fast on County Road 47. Use of sustainable materials (concrete production is very greenhouse gas emission heavy) Safety improvements; specifically the lack of barriers on the sides of the road. It is very narrow as it crosses elm creek, especially in the winter. It should be 4 lanes (2 in each direction) since the city keeps allowing more houses to be built on the west. With all the new construction it may be good to make it 4 lanes Speeds are too fast for this curvy road, and I believe the developers should be required to pay for improvements along this road, which has become very dangerous with the amount of traffic produced. We need trees to block the increased traffic on 47 with all the new construction. No thought given to people who have lived there for years while building houses as fast as you can???? I have seen multiple accidents there. It seems like the grade is too high and Cars slide into the intersec Need a safe way on foot or bike to get from Steeple Hill neighborhood (47 and Vicksburg area) to Meadow Ridge Elementary. Be sure to consider drainage. Please revisit is Vicksburg Ln between Cty Rd. 6 and Highway 55. Change to single lane w/turn lanes. From our neighborhood (Elm Creek Meadows) to walk or bike is frightening. Please come and walk it and cross the bridge over Elm Creek. The crossing at Lake Camelot Park is dangerous and needs to be moved. Please complete a trail on the north side of the road between Cheshire and Vicksburg. I feel very strongly that i do not want CR47 to be a 4-lane highway. I do think improvements to add a walkway or bike path could provide value and safety. An extra lane would be awesome. Please do not work on Cty rd 47 at same time as Rockford RD I’m assuming that County rd 47 is also known as bass lake roaf Ideally County Road 47 would be straightened at least somewhat to make driving it safer. I would suggest that 47 become a major road in Plymouth consisting of sidewalks and a minimum of three lanes that could switch depending on time of day. There are several dangerous curves on 47 where blind spots are present. Also, would improve city to have cross walks and bike path along road especially providing walk ability to school sidewalk,safe pedestrian crossings, longer turn lanes(see entrance to steeple hill), Snow removal is subpar at best The previous page should have had a choice for "I do not currently use 47." Otherwise I find the road quite adequate Just west of Cheshire there is a hill and curve that can be tricky in the dark and in slippery conditions, hazardous Left turn lanes and two lanes in each direction under the I-494 bridge - an absolute must. I would love to direct access added from 47 on to 494. Speed limit reduction. Continue configuration as a two lane road, but add a center turn lane. Asphalt sidewalks adjacent to the road. When I leave the Elm Creek Development on Cty Rd 47 to bike or walk, it is life-threatening, as I have barely any room between the edge of road and the traffic. I use this road to access the dog park. The dog park is the primary reason I use this road. The narrow bridge between Vicksburg and Peony is very dangerous during the summer for bikers A sidewalk built from Troy Ln to Meadow Ridge Elementary school The speed limit on this road is excessive, the road is in poor shape and it has increased traffic with the addition of Meadow Ridge, more students at WHS and rapid housing devt. Needs to be safer! I hardly go that far north to use it very often. I live 1 block from Wayzata...ok? I.observed lot of fatal accidents happened on co ed 47 in 2018 at intersection of vicksburg and co rd 47. Major concern is peed limit. Every one goes about 55 mph . In my opinion speed shoukd be 45 m Access to the new trails from the north side of CR 47 east of Peony would be great. Safer during winter month Would definitely love a sidewalk/trail, especially between Peony and Dunkirk. The speed limit is much too high for an area like this that is so heavily populated with residential communities. A walking or bike trail would be nice if possible, but please DO NOT widen the road. There is not that much traffic, and widening would only further deteriorate the beauty and charm of that area. I live In The Elm Creek meadows development. It is dangerous to access daily by car or to get to the dog park just across the road. I don't use the road frequently enough to have much input. I feel like it mostly gets used in the summer for excess traffic trying to leave the cities for vacation "up north." Since I am a very infrequent user of Cty. Rd 47 I would defer to the frequent users for all safety issues (biking and pedestrian, in particular) Add restaurants please CR 47 needs to have a protected ped/bike facility to connect to the various N-S facilities(along Peony, Vicksburg, Cheshire , access (Meadow Ridge) and Lake Camelot Park. CR47 between Lawndale and Vicksburg have speed limits of 50 MPH, divided double lanes might be a thing to consider It is dangerous to travel that area on a bike because of all the tragic. I'm on Cty 47 easily 4 times a day. Shoulder is not wide enough for pedestrians, bikers or residents when they go out to collect their mail. 40 mph is appropriate for this road because of that. Two lanes would be nice While traffic improvements are most important to me, there should be wider shoulders so that it is not dangerous to bike along the road. regardless of road changes, i'd like to see speed reduced on this road both for safety and noise levels. Last fall orientation we were almost hit by a car walking to the school! A sidewalk and tunnel underneath is needed. slower speed limit because families and kids cross to get to school. Also a tunnel underneath 47 so there would be access to meadow ridge from north of 47. In general, Plymouth roads should be improved for pedestrians and bicyclists. With the bridge on Rockford Road being replaced this summer, hopefully, County Rd 47 will not also be blocked as it is a parallel road. Ensure water drainage is functioning on the sides of 47 near 494. The storm drains have a hard time keeping up with rain, creating foooding. Need to reduce speed limit to allow traffic to enter/exit Cty Rd 47 from Yucca Lane. This is a very windy curved rd and pedestrians are trying to access via 47. No turn on red or blinking yellow at Cheshire Pkwy intersection. The limited views result in drivers pulling into traffic and cutting off other motorists. Rarely us this county road. We are quite south of this road. Sidewalks that are adjacent to the road. These type are easier to plow. The hills and curves of Cty 47 adds to the danger of a biker or pedestrian not being SEEN by fast traffic. No place to get out of the way!! I walk to 101 along there and I don't always feel safe because the cars come so close to me. It can made be safer. After looking up the road, I know which road this is and I haven't driven on it for at least 3 years. What I remember about it, is that it seemed to have too high a speed limit for how curvy it was with residential areas. But again, I haven't driven on it in a while so I don't have an up-to-date perspective. There is virtually no ability to walk on County Road 47 - with the amount of residential development in the area, it is vital that pedestrian access is provided on this road. Dedicated turn lanes are needed. I live off of the 47/Dunkirk turn-almost rear ended many times With development west of Hwy 494 off Cty Rd 47, traffic volume has increased a great deal requiring updated measures to maintain safety and traffic flow! Lower speed limit or wider shoulders Sure would be nice if the road were straighter I don't travel Co Rd 47 often. It likely can't handle the current volume of traffic due to the rampant development and likely needs widening/more lanes, and perhaps space for bikes and pedestrians. I don't know if people walk up that way like they do along Schmidt Lake Road. With rockfor rd bridge work coming soon, this will be a major alternative While overall traffic has increased, need to make sure projects don’t overlap The drivers are reckless and dangerous, especially trucks and large SUV's, they will run you off the road, pass in no passing lanes and I have even had people vandalize my car while in it (in traffic). I do not travel through CR 47 I have never used CR 47 (I live in southern-most Plymouth) We have tons of children in our neighborhood in walking distance to meadow ridge elementary, and a safe sidewalk system would be essential. Also some sort of pedestrian overpass between the Steeple Hill and Teravista neighborhoods instead of having people dart across the road with kids and strollers. It is extremely dangerous to drive and walk on county 47. Please make improvements to the road asap. Long overdue. Many walking paths in the area need safer crossings of 47 in that area. No sidewalk on either side of the road. The CR 47/Yucca Lane N. intersection is a bad accident waiting to happen as cars struggle to get onto CR47, there is a lot of traffic approaching from both directions. Speed limit should be lowered. Trying to turn out of the neighborhoods along County Road 47 during rush hour is very difficult. The rapid growth of homes and addition of two elementary schools makes safety paramount and urgent. The road is windy and too narrow and the shoulder is dangerously narrow or non-existent especially over bridges. With the current status of 47, I feel there are significant safety concerns related to bikers and pedestrians not only attempting to cross the road but also those walking/running/biking on it I would like to know where current traffic on County Road 47 will be diverted. My neighborhood is dependent on Fernbrook Lane. After the Vicksburg Lane closure a couple of years ago and the closure of County Road 47 recently, Fernbrook became a nightmare of a traffic jam. Fernbrook has finally been resurfaced -- I would hate to see it overused once again! More and more houses are being built, the ability for kids safely bike/walk along this road are critical. Also improved lightning on major curves and intersections would be nice. The volume of traffic on this road has increased greatly and the speed limit is too high for the combination of heavy traffic and condition of road. Drivers take risks pulling in front of cars when they turn onto 47 because there is a constant flow of traffic and little visibility. Dangerous during commuter times Trees, bike paths, and natural blockage from all the traffic. Can't believe no thought is given to those who haven't experienced years while you build as fast as you can decreasing our property value to make a buck. How about putting kids to some of that back in? we pay a lot in tax $ so this is my input for CR 47 but unsure of other competing priorities for investments to improve our community Would be nice to have some lighting along some of the curves - difficult to see (even with car lights on) in the night. While this survey was about Co Rd 47, it intersects with 101 which also has issues that must be addressed. North and south access to the Plymouth dog park would also be helpful This was a nice country road at one point, but farms have turned into neighborhoods and it needs to be improved to support population density (includes the school). Bikes/walkers need a protected path--on the shoulder isn't safe. Speeds are way too fast. I don't even feel safe driving on 47 with another car always on my bumper when going a reasonable speed. Lighting is also bad for a curvy road, which makes it dangerous to see deer and slippery conditions. There have been car accidents on Vicksburg/47 due to the flashing yellow and speeds involved. Please look into traffic calming immediately as improvements are discussed. The flashing yellow arrows should just be replaced with solid green as they have been for many years--they mean the same thing--the problem is that the arrow gives the false impression that it's ok to turn. Leave the road alone. Many high school children get off the bus and cross county road 47 to get to their homes faster. It would be nice to have side walks and cross walks to keep the kids safe. The steep hill and curve where our street meets 47 make it difficult to see approaching traffic, thus making it dangerous to cross. BACKGROUND: Roadways that are not designated as County State Aid Highway (CSAH), which are at least partially supported by state aid (gas taxes), are designated County Road (CR) and generally serve cities under 5,000 population and carry low levels of traffic volumes. This class of roads, like County Road 47, is functionally classified as “B” type minor arterials or collector streets. Only about 40 centerline miles of the county roadway system are designated as county road. The funding source for maintenance and construction is primarily county property tax so they are often overlooked when it comes to maintenance and upgrades. The function of some roadways change or transition over time due to factors such as increased urbanization or other significant changes in the roadway system. System realignments and adjustments are often made to facilitate functional changes prompted by new land development and redevelopment. Jurisdictional transfers are generally infrequent. Hennepin County typically processes 2-3 transfers in an average year. County roads that are primarily serving a collector type local street function are occasionally turned back to cities when the transfer serves both agency’s purposes. Recent transfers of this type include Rogers Drive (formerly CSAH 49) in Rogers and West River Road (formerly CSAH 12) in Brooklyn Park. The turnback of a county roadway to a city is accomplished through a dialog intended to lessen the maintenance burden to the accepting city. The county’s policy is to ensure the road has been upgraded to provide a long service life prior to the turnback. Hennepin County will not proceed with a turnback action to a city unless the city is comfortable with the terms of the turnback. Turnbacks are always the subject of a formal agreement between the accepting city and county. Higher volume local streets that are transitioning to serving longer trips are often added to the county roadway system by agreement with the affected city. A recent example of this type of transfer was the designation of Noble Parkway as new CSAH 12 in the City of Brooklyn Park. This transfer was done as an exchange for the county transferring old CSAH 12 (West River Road) to the city. Staff is intimately familiar with this jurisdictional transfer as well as the turnback agreement. The attached 2030 Hennepin County Transportation System Plan (2030 HC-TSP) Map E, entitled “Jurisdiction and Long-range Transportation Issue Areas”, displays potential candidates for jurisdictional transfers based on an evaluation of the county roadway system and based on discussions with MnDOT Page 40 and a number of cities. The items identified on the map are provided for discussion purposes only. The identified roadway segments do not constitute implicit support by the affected agencies for any of the potential revisions. County Road 47, and Peony Lane and CSAH 101 north of TH 55 are identified as jurisdictional transfer candidates. Jurisdictional transfers or exchanges are generally a result of a mutually agreed transaction between both affected agencies. As part of the transfer of a county roadway to another agency, Hennepin County will try to ensure that the roadway has an adequate design life so as not to burden the accepting agency with undue maintenance needs. To do this, the county will often provide improvements such as a pavement overlay and other miscellaneous upgrades for a roadway before it is transferred to a city. Staff has identified a number of issues that should be addressed if a jurisdictional transfer of any of the roadways identified by Hennepin County were to be considered (see attached Hennepin County Road 47 Summary of Issues). While some improvements to County Road 47 have been made concurrent with developments or other major roadway improvements in the area, some deficiencies remain and the roadway is not built to current urban standards with curb and gutter. Several traffic signals have also been added or upgraded at all major intersections since 2005 which has improved safety but design deficiencies remain which likely contribute to crashes (see attached CR 47 Crash Analysis Report). As indicated preciously, staff is familiar with the turnback agreement between Hennepin County and the city of Brooklyn Park for the CSAH 12 (West River Road)-Noble Parkway jurisdictional transfer. Subsequent to a 2010 discussion with Hennepin County regarding the possible jurisdictional transfer of County Road 47 and Peony Lane/Lawndale Lane, staff prepared a draft Agreement for Jurisdictional Transfer between Hennepin County and the City of Plymouth. This draft agreement was based on the same concept as the agreement that was approved between Brooklyn Park and Hennepin County. This agreement was presented to Hennepin County for consideration, however, staff never received a response. This agreement has been updated to reflect the number of improvements that have been made in the city since 2010 (see attached Agreement for Jurisdictional Transfer between Hennepin County and the City of Plymouth). 3. Legend Roadway Segments Over Capacity (2030) City Limits Lakes Source: SRF Consulting Group, Inc., 2007 Page 49 HENNEPIN COUNTY ROAD 47 SUMMARY OF ISSUES CR 47 from Northwest Boulevard (CSAH 61) to CSAH 101 • The westerly 0.1 mile segment of CR 47 was upgraded when CSAH 101 was upgraded. The 0.3 mile segment from Vicksburg Lane easterly was upgraded with the Taryn Hills development, however, not to urban design standards. Another approximately 0.3 mile segment was upgraded with curb and gutter at Lawndale Lane with the Peony Lane project. • The remaining asphalt surface was generally in poor to failing condition until the County overlaid the road in 2008 and the culverts are in fair to poor condition. There are locations where the subgrade was failing and other areas where culvert crossings had settled significantly but these spots have been repaired. There are a few of locations remaining where horizontal and/or vertical curves do not meet a 40 mph design standard. • The entire roadway is eligible for designation as a Municipal State Aid (MSA) route upon turnback with no impact on our MSA mileage availability. Designating this roadway as an MSA route would generate approximately $80,000 per year in needs apportionment. • The Comprehensive Plan identifies capacity improvements to CR 47 possibly in the form of a three-lane facility from Lawndale Lane to Vicksburg Lane. • The estimated cost for complete reconstruction is $8.5M. The City’s street maintenance cost is approximately $16,000/centerline mile/year. • The City’s Capital Improvement Program (CIP) does not include the reconstruction of CR 47, however, it is listed as a pending project. • Traffic volumes on CR 47 range from 4,000 vpd near CSAH 101 to 8,000 vpd near CSAH 61. • Since 2005 traffic signals have been installed on CR 47 at CSAH 101, Peony Lane/Lawndale Lane, Vicksburg Lane and Fernbrook Lane and the signal and intersection at CSAH 61 (Northwest Boulevard) was upgraded. Turnback Agreement Options: • Reimbursement by the County an amount equal to the County's typical share of a reconstruction project less other recent investments in the corridor could be considered ($6M). In addition, the County could reimburse an amount equal to what their share would have been had they been responsible for the upgrades to Peony Lane ($16M). Peony Lane from TH 55 to north city limits • The traffic volumes on Peony Lane range from 24,000 vehicles per day (vpd) near Wayzata High School to an estimated 10,400 vpd near CR 47. • The City has invested nearly $20M for the construction of this portion of Peony Lane. Turnback Agreement Options: Page 50 • Peony Lane from TH 55 to north city limits (2.4 miles) could be considered in the exchange for CR 47 (4.0 miles) and CSAH 101 (0.9 miles of ½ of the road). Therefore, a seasonal trend analysis was performed. The results can be found in Table 3 and Figure 1. When averaged on a seasonal basis, the data indicate an increase in crashes in 2016 across most months. While up considerably from 2015, the winter months of early 2016 had a normal level of crash activity. In contrast, the spring and summer months of 2016 had crash totals above the historical normal range. The January through August 2016 crash total is 23 crashes, which currently exceeds the total of 2015 (20) or any year in the past 5 except 2012 (28). Accordingly, if the trend continues, the 2016 annual total of crashes can be expected to approach, if not exceed, the 5-year high of 28 crashes. There is a negligible correlation between annual total crashes in this area and time, and so no specific annual forecast can be given. Page 54 Table 3. Incident density was greatest around the intersection of County Road 47 and Vicksburg Ln. Crash density was also evident in the area of the intersection with Peony Ln/Lawndale Ln and stretching to the west. To a lesser degree, the intersection with Northwest Blvd was the only other intersection to show a relative density of crash incidents. Looking at the 2016 crash incident density map in Figure 3, there is a noticeable difference in the 2016 (January – August) density profile as compared to the prior 5 years. The location with the highest density of crash incidents is County Road 47 and Northwest Blvd, and stretching a little to the west. The intersection with Vicksburg Ln shows a dramatic decrease in relative density, which may be a result of the closer of Vicksburg Ln immediately south of that intersection in March 2016. Report prepared by Jared Gilbert, Public Safety Analyst Page 57 Agreement No. PW __-__-__ County Road 47 City of Plymouth County of Hennepin AGREEMENT FOR JURISDICTIONAL TRANSFER THIS AGREEMENT, made and entered into this ___ day of ______________, 2016, by and between the County of Hennepin, a body politic and corporate under the laws of the State of Minnesota, hereinafter referred to as the “County”, and the City of Plymouth, a body politic and corporate under the laws of the State of Minnesota, hereinafter referred to as the “City”. WITNESSETH: WHEREAS, the County and the City agree that the portion of County Road (CR) 47 (Hackamore Road) between County State Aid Highway (CSAH) 101 and CSAH 61 under the jurisdiction of the County should be transferred to the City; and WHEREAS, the County and the City agree that the portion of Peony Lane /Lawndale Lane between TH 55 and the north corporate limits under jurisdiction of the City should be transferred to the County and shall be designated as new CSAH 101; and WHEREAS, the County and the City for some time have been negotiating to bring about said roadway transfers; and WHEREAS, it is agreed by both the County and the City that CR 47 has not been constructed to County or State Aid Standards, and the County normally provides necessary roadway surface improvements or provides a cash equivalent for same to a City in conjunction with a jurisdictional transfer of a County roadway to a City; and WHEREAS, the County resurfaced CR 47 2008 and installed a traffic signal at the intersection of CR 47 and Vicksburg Lane and at CR 47 and Cheshire Lane at no cost to the city; and WHEREAS, it is agreed by both the County and the City that portions of Peony Lane/ Lawndale Lane between TH 55 and the north corporate limits has been constructed to State Aid Standards, and the City normally participates in the cost of County roadway improvements and upgrades; and WHEREAS, the City has invested $20,000,000 in upgrades to Peony Lane between TH 55 and the north corporate limits to State Aid Standards, and the County did not participate in those costs; and WHEREAS, the City is willing to receive jurisdiction of CR 47 within the aforesaid limits with the understanding that the County would provide cash to the City in the amount the County would incur to fully upgrade CR 47 to State Aid Standards ($8,500,000), less the normal City participation amount ($1,500,000), and less the value of the recently completed improvements to CR 47 identified above ($1,000,000) which results in an amount of $6,000,000 due for the deficiencies in County Road 47. In addition, the County would provide cash to the City in the amount $16,000,000 which represents what would be the normal County participation amount to upgrade Peony Lane/Lawndale Lane from TH 55 to the north corporate limits; and Page 58 WHEREAS, the smooth and orderly implementation of said roadway transfers are in the best interests of the public; the City, and the County; and WHEREAS, it is contemplated that said work be carried out by the parties hereto under the provisions of Minnesota Statutes 1992, Section 162.17, Subdivision I and Section 471.59. NOW, THEREFORE, IT IS HEREBY AGREED: I The City hereby agrees that the County may revoke the designation of County Road on CR 47 between CSAH 101 and CSAH 61, and the City will accept jurisdiction of the roadway under provisions of Minnesota Statutes 1992, Section 162.02. The City agrees to accept such conveyance subject to existing encumbrances such as permits and easements. II The County agrees that the City will revoke its Municipal State Aid Designation of Peony Lane/Lawndale Lane between TH 55 and the north corporate limits within the City and the County will accept jurisdiction of Peony Lane /Lawndale Lane between TH 55 and the north corporate limits under provisions of Minnesota Statutes 1992 Section 162.02. The County agrees to accept such conveyance subject to existing encumbrances such as permits and easements. III Upon approval of the Agreement, the County will request that the Commissioner of the Minnesota Department of Transportation remove the above identified County roadway from the County Highway System and the City will request that the Commissioner of Minnesota Department of Transportation remove the above identified road from Municipal State Aid designation. The City and the County, by this Agreement, concur in these changes of designations and jurisdictions. Page 59 IV Transfer of the aforesaid roadways shall occur and become effective on the first day of the month immediately following the approval of the CSAH and Municipal State Aid designation changes by the Commissioner of the Minnesota Department of Transportation as hereinbefore set forth in Section I and II. V The County shall provide the City and the City shall provide the County with the following information and records, to the extent that they are available for the routes to be transferred. 1. As-built construction plans, microfilm records, and electronic files. 2. Inventory data. 3. History of most recent improvements/upgrades. VI Upon transfer to the City of the route hereinbefore identified in Section I, the City hereby agrees to do and perform all roadway and other maintenance at its sole cost and expense. Upon transfer to the County of the route hereinbefore identified in Section II, the County agrees to do and perform all roadway and other maintenance at its sole cost and expense. VII It is understood and agreed that the traffic control signal systems at the intersections of Old Rockford Road and Peony Lane, Schmidt Lake Road and Peony Lane and Lawndale Lane and CR 47 shall become the property of the County. As built construction drawings along with electronic files will be provided to the County. It is further understood and agreed that the traffic control signal system at the intersection of CR 47 and Vicksburg Lane and CR 47 and Cheshire Lane shall become the property of the City. As built construction drawings along with electronic files will be provided to the City. VIII The City will receive jurisdiction of County Road 47 in its existing condition. However, it is understood and agreed by the parties hereto that the County will provide cash to the City in the amount of $22,000,000 to be used for the City’s cost to upgrade CR 47 from CSAH 101 to CSAH 61 and to reimburse the City for investment made to upgrade the roadway to State Aid Standards. IX It is further agreed that each party to this Agreement shall not be responsible or liable to the other or to any other person whosoever for any claims, damages, demands, judgments, fines, penalties, expenses, actions, or causes of actions of any kind or character arising out of or by reason of the negligent performance of any Page 60 work or part hereof by the other in connection with the roadway jurisdictional transfer herein provided for; and each party further agrees to defend at its sole cost and expense any action or proceeding commenced for the purpose of asserting any claim of whatsoever character arising in connection with or by virtue of past and future work performed by it on said transferred roadways. X In order to coordinate the services of the County with the activities of the City so as to accomplish the purposes of this Agreement, the County Engineer or designated representative shall manage this Agreement on behalf of the County and serve as liaison between the County and the City. XII The provisions of Minnesota Statutes 1992, Section 181.59 and of any applicable local ordinance relating to civil rights and discrimination and the Affirmative Action Policy statement of Hennepin County shall be considered a part of this Agreement as though fully set forth herein.
