Pursuant to due call and notice thereof, a regular meeting of the Village
!:Council of the Village of Plymouth, Minnesota, was held on the 4th day of
December, 1972. The following members were present: Mayor Hilde, Councilmen
;'Hunt, Spaeth, Seibold and Neils. The following members were absent: None.
Councilman Neils introduced the following Resolution and moved its
adoption:
RESOLUTION N0. 72-510
A RESOLUTION AUTHORIZING THE RELEASE OF
$26,543 OF THE SECURITY FURNISHED BY
REGIONAL DEVELOPMENT CORPORATION IN
CONNECTION WITH CONTRACT NO. A-230
WHEREAS, the Village of Plymouth entered into a contract with Regional
.Development Corporation on August 10, 1970 (Development Contract No. A-230),
and
WHEREAS, in connection with said development contract Regional Development
Corporation did deposit with the Village of Plymouth the sum of $27,643 for the
purpose of securing the completion of a sanitary sewer system within the devel-
,`opment known as Fox Meadow, First Addition, and
WHEREAS, the Village of Plymouth and Regional Development Corporation
''have been in disagreement as to the sufficiency of the completed sanitary
sewer system, and
WHEREAS, said Regional Development Corporation did bring an action at law
;.against the Village of Plymouth demanding the return of the $27,643 deposited
by the Regional Development Corporation to secure the performance of that part
,;of the contract relating to the installation of sanitary sewer, and
WHEREAS, under date of November 30, 1972 the District Court of Hennepin
fCounty, Minnesota did enter its Findings of Fact, Conclusions of Law and
'::Order for Judgment ordering the Village of Plymouth to refund to the Regional
Development Corporation the sum of $26,543 to Regional Development Corporation
iiforthwith,
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE VILLAGE COUNCIL OF THE VILLA
OF PLYMOUTH AS FOLLOWS:
1. That the Village Manager is authorized and directed to refund to
Regional Development Corporation $26,543 from the security deposit
held by the Village of Plymouth in connection with Development Con-
tract No. A-230,
2. That the balance of the funds on deposit be retained by the Village
of Plymouth until the remainder of the corrective work in said
sanitary sewer system has been completed in accordance with the said
order of the District Court.
The motion for the adoption of the foregoing Resolution was duly seconded
iby Councilman Hunt, and upon vote being taken thereon, the following voted in
favor thereof:

Councilmen Hunt, Spaeth, Seibold and Neils. The following
Mayor Hilde. Whereupon the Resolution was declared duly passed

I, the undersigned, being the duly qualified and acting Clerk of the
Village of Plymouth, Minnesota, hereby certify that I have carefully compared
the foregoing extract of the minutes of a regular meeting of the Village
Council of said Village held on the 4th day of December, 1972 with the original
thereof on file in my office, and the same is a full, true and complete trans-
cript therefrom.
