VILLAGE OF PLYMOUTH

Pursuant to due call and notice thereof, a regular meeting of the Village
,Council of the Village of Plymouth. Minnesota, was held on the 6th day of
!November, 1972. The following members were present: Mayor Hilde, Councilmen
;Hunt, Neils, Seibold, and Spaeth. The following members were absent: None
Councilman Hunt introduced the following Resolution and moved its
!adoption:
RESOLUTION NO. 72-466
1 WHEREAS, the Village of Plymouth has awarded a contract to construct
{storm sewer along County Road No. 6 under Project No. 116-001, and
11 WHEREAS, a permit is required from Hennepin County to construct this
dstorm sewer, and
WHEREAS, Hennepin County has requested that the Village take action to
hold the County harmless from liability or damages that may arise during or
!after, but as a result of, said construction by the Village of Plymouth.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE,VILLME OF
PLYMOUTH, in consideration for the granting of County Utility Permit No. 2963,
!the Village of :Plymouth, a body politic and corporate, agrees to save and hold
Charmless the County of Hennepin from any and all 'liability or damages that
may arise either at the time of construction or thereafter as a result of said
construction by the Village, its contractors, agents or servants as it
relates to Village.Project No. 116-001.
The motion for the adoption of the foregoing Resolution was duly seconded
by Councilman Seibold, and upon vote being taken thereon, the following voted
in favor thereof: Mayor Hilde, councilmen Hunt, Spaeth, Seibold, and Neils.
The following voted against: None. Whereupon the Resolution was declared
Idully passed and adopted.

I, the -undersigned, being the duly qualified and acting Clerk of the
Village of Plymouth, Minrrsota, hereby certify that I have carefully compared
the foregoing extract of the minutes of a regularmeeting of the Village Council
of said Village held November 6, 1972 with the original thereof on file in my
office and the Same is a full, true, and complete transcript therefrom.
