Pursuant to due call and notice thereof, a regular meeting of the Village
Council of the Village of Plymouth, Minnesota was held on the 6th day of
;'November, 1972. The following members were present: Mayor Hilde, Councilmen
,;Spaeth, Hunt, Seibold, and Neils. The following members were absent: None.

Councilman Seibold introduced the following Resolution and moved its
.!adoption:
RESOLUTION NO. 72-421
f? A RESOLUTION WAIVING THE REQUIREMENT OF SECTION 462.358
SUBDIVISION 4, MINNESOTA STATUTES AND SECTION 9.02 OF
CHAPTER VII OF THE VILLAGE CODE RELATIVE TO CONVEYANCES
BY METES AND BOUNDS OF PARCELS OF LAND CONTAINING LESS
THAN FIVE ACRES
WHEREAS, Harold F. Ernst, on behalf of the owner, Catherine Ernst, who
+jowns land in the South 1/2 Of Section 22, has requested a subdivision
ivariance, and

it WHEREAS, the Village Planning Commission has reviewed said request and
recommends approval, and
I WHEREAS, the Village Council has now determined that the subdivision
lof said land into two parcels, one of which would contain less than five (5)
,;acres, would not interfere with the purposes of the Subdivision Regulations
{!of the Village of Plymouth and that a refusal to permit such subdivision
(would create an unnecessary hardship on such owner,
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE
10 PLYMOUTH AS FOLLOWS:
1) Compliance with the provisions of Section 462.358 Subdivision 4,
Minnesota Statutes and Section 9.02 of Chapter VII of the Village
i Code relating to conveyances by metes and bounds of parcels of land
!� containing an area of less than five (5) acres is hereby waived
with respect to the following described parcels:
j PARCEL A
The North 862' of followira described tract: Com at the
intersection of E line of SW 1/4 and Northeasterly line
of State Highway 55, thence North along E line of SW 1/4
to South line of North 1/4 of SW 1/4 thence West along said
S line to E line of Reg. Land Survey No. 1173, thence S
along E line of said Land Survey to a point 175' N from
Northerly line of State Hwy. 55, thence E 120' thence S
to Northerly line of said Hwy. thence Easterly to beg
except road, Sec. 22-118-22
PARCEL B
That part of the following described tract lying South of
the Northerly 862' thereof. Com at the intersection of E
line of SW 1/4 and Northeasterly line of State Hwy. 55, thence
N along E line of SW 1/4 to South line of North 1/4 of SW 1/4
thence West along said S line to E line of Reg. Land Survey
No. 1173, thence S along E line of said Land Survey to a point
175' N from Northerly line of State Hwy. 55, thence E 120'
thence S to Northerly line of said Hwy. thence Easterly to beg
