VILLAGE OF PLYMOUTH

Pursuant to due call and notice thereof, a regular meeting of the Village
Council of the Village of Plymouth, Minnesota, was held on the 16th day of
October, 1972. The following members were present: Mayor Hilde, Councilmen

;;Hunt, Spaeth, Seibold and Neils. The following members were absent: None.

Councilman Seibold introduced the following Resolution and moved its
adoption:
RESOLUTION NO. 72-408
WHEREAS, the Metropolitan Council on October 12, 1972 approved the im- i
;position of new revenue generating devices to finance a portion of the Metro-
politan Sewer Board's budget, and
WHEREAS, these proposed charges, if imposed, would create an undue and
!iexcessive burden upon persons wishing to construct homes and other facilities
';within the Village of Plymouth requiring access to the Metropolitan Sanitary
Sewer System, and
WHEREAS, numerous communities in the metropolitan area have formed to-
igether in order that they might execute a Joint Powers Agreement pursuant to
(Minnesota Statutes to test the validity of the new revenue system of the
Metropolitan Council,
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF PLYMOUTH that the Mayor and Village Manager are hereby authorized
,and directed to execute a Joint Powers Agreement with the City of Brooklyn
Center and/or others, the purpose of which shall be to challenge the new
Service Availibility Charge method of financing a part of the Metropolitan
;Sewer System, and
FURTNER, that a sum not to exceed $1,000 is hereby appropriated from the
!Sanitary Sewer Fund to assist in the expenses incurred by this action.
The motion for the adoption of the foregoing Resolution was duly seconded
by Councilman Hunt, and upon vote being taken thereon, the following voted in
!favor thereof: Mayor Hilde, Councilmen Hunt, Spaeth, Seibold and Neils. The
following voted against or abstained: None. Whereupon the Resolution was
declared duly passed and adopted.
