Pursuant to due call and notice thereof, a special meeting of 1! ,the Village Council of the Village of Plymouth, Minnesota. was held i� on the 28th day of August. 1072. The following members were pre- sent: Councilmen Hunt, Spaeth, Seibold and Neils. The following !members were absent: Mayor Hilde. Councilman Spaeth introduced the following Resolution and ;:moved its adoption: RESOLUTION NO. 72-322 ii WHEREAS, a Subdivision Variance has been requested by Harlan C. Freund, 'Downer of ppoperty located in the South 15 of Section 15 of the Village of ljPlymouth, and WHEREAS, the Village Council has now determined that the subdivision ;sof said land into two parcels, each containing less than five (5) acres would �,not interfere with the purposes of the Subdivision Regulations of the Viilage lof Plymouth and that a refusal to permit such subdivision would create an un - ;necessary hardship on said owner, NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE VILLAGE COUNCIL OF THE ,VILLAGE OF PLYMOUTH that compliance with the provisions of Section 462.358, :Subdivision 4. Minnesota Statutes and Chapter VII of the Village Code relating oto conveyances of unplatted land containing an area of less than five (5) acres is hereby waived with respect to the following described parcels: PARCEL A (28.358 square - e -et) All that part of Tract B, Registered Land Survey No. 652, Hennepin County. Minnesota, lying Northerly of a line drawn from a point on the Westerly line of said Tract B, 100.00 feet Northerly from the Southwesterly corner thereof, to a point on the Easterly line of said Tract B, 115.55 feet Northerly from the Southeasterly corner thereof. Subject to a 12 foot wide driveway easement over and across the above described Tract, the center line of said easement described as follows: Commencing at the most Northerly corner of said Tract B, thence Southerly along the Easterly line of said Tract B a dis- tance of 26.00 feet; thence Southwesterly to a point to the South line of the above described Tract distant 63.00 feet East of the Southwest corner thereof. PARCEL B (17,138 square feet All that part of Tract B, Registered Land Survey No. 652, Hennepin County, Minnesota, lying Southerly of a line drawn from a point on the Westerly line of said Tract B, 100.00 feet Northerly from the Southwesterly corner thereof, to a point on the Easterly line of said Tract B. 115.55 feet Northerly from the Southeasterly corner thereof. Together with a 12 foot driveway wide easement over and across that part of Tract B described as follows: All that part of Tract B, Registered Land Survey No. 652, Hennepin County, Minnesota, lying Northerly of a line drawn from a point on the Westerly line of said Tract B, 100.00 feet Northerly from the Southwesterly corner there- of, to a point on the Easterly line of said Tract B, 115.55 feet Northerly from the Southeasterly corner thereof. Thence Southerly along the Easterly line of said Tract B a distance of 27.00 feet to the point of beginning of the center line to be described; thence Southwesterly to a point in the Northerly line of the first above described Tract distant 63.00 feet Easterly from the Northwesterly corner thereof. The motion for the adoption of the foregoing Resolution was j 'iduly seconded by Councilman Seibold, and upon vote being taken 11 :thereon, the following voted in favor thereof: Councilmen Hunt, ;,Spaeth, Seibold and Neils. The following voted against or abstain - Jed: None. Whereupon the Resolution was declared duly passed and 'adopted.
