HomeMy WebLinkAboutCity Council Resolution 1972-295AJPk` 1'Y EXTRACT OF MINUTES OF MEETING OF VILLAGE COUNCIL OF PLYMOUTH, MINNESOTA Pursuant to due call and notice thereof, a special meeting iof the Village Council of the Village of Plymouth, Minnesota, was i held on the 6th day of October, 1972, commencing at 7:12 o'clock Ep.m. in the Council Chambers of the Public Works Building, 14900 Twenty-third Avenue North, Plymouth. The following members were 'present: Mayor Hilde Councilmen Hunt, Spaeth, Seibold and Neils.' The following members were absent: None. *** Councilman Seibold introduced the following Resolution and moved its adoption: f RESOLUTION NO. 72-295 (A) l A RESOLUTICVA CONFIRMING AND ADOPTING THE ASSESSMENT FOR ! PARKERS LAKE SEWER AND WATER PROJECT NO. 132 WHEREAS, pursuant to due and proper notice according to law an assess- �ment hearing was held on the 4th day of October, 1972 commencing at 7:35 o`clock �p.m. relating to the special assessments for Parkers Lake Sewer and Water Projec No. 132, and WHEREAS. all persons present desiring to be heard were heard and their objections, if any, were noted. I f NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE VILLAGE COUNCIL OF THE IVILLAGC OF PLYMOUTH, AS FOLLOWS: ?. The Village Clerk has, with the assistance of Bonestroo, Rosene, Anderlik & Associates, Inc., engineers heretofore selected by this Council for such purpose, calculated the proper amounts to be j specially assessed for Parkers Lake Sewer and Water Project No. 132 against every assessable lot, piece or parcel of land, in accord- ance with the provisions of law, and has prepared and filed in her office tabulated statements in duplicate showing the proper des- cription of each and every lot, piece or parcel of land to be specially assessed in the amount calculated against the same. 2. Notice has been duly published as required by law that this Council_ would meet in special session at this time and place to pass on the proposed assessment. 3. The proposed assessment has at all times since its filing been open to inspection and copying by all persons interested, and an oppor- tunity has been given to all interested persons to present their objections, if any, to such proposed assessment, or to any item thereof, and three objections have been filed. 1 G; 4. This Council finds that each of the lots, pieces or parcels of land enumerated in said proposed assessment was and is specially benefited by the construction of Parkers Lake Sewer and Water Project No. 132 in the amount in said proposed assessment set opposite the description of each such lot, piece or parcel of land and that said amount is hereby levied and assessed. S. Such proposed assessment is affirmed, adopted and confirmed, and the j sums fixed; and the sums fixed and named in said proposed assessment with the changes and alterations hereinabove made are affirmed, adopted and confirmed -as the proper special assessment for each of .. said lots, pieces or parcels of land respectively. i 6. Said assessment so affirmed, adopted and confirmed shall be certified j to by the Village Clerk and filed in her office and shall thereupon 1� be and constitute the special assessment for Parkers Lake Sewer and 3 �j Water Project No. 132. i 7. The amounts assessed against each lot, piece or parcel of land shall bear interest from the date hereof until the same have been paid at the rate of eight (8) percent per annum. 8. Such assessments shall be payable in ten (10) equal annual install- ments payable at the first day of January in each year, beginning in the year 1973, and continuing until all of said installments shall have been paid, each installment to be collected with taxes collect- able during said year by the County Auditor. To the first install- ment shall be added interest on the entire assessment from the date hereof of December 31, 1972. To each subsequent installment shall be added interest for one year on all unpaid installments. 9. The Village Clerk is hereby directed to make up and file in the office of the County Auditor of Hennepin County a certified state- ment of the amount of all of such unpaid assessments and the amount which will be due thereon on the first day of January in each year. The motion for the adoption of the foregoing Resolution was duly seconded by Councilman Neils , and upon vote being taken "thereon, the following voted in favor thereof: Mayor Hilde. Councilmen Hunt, Spaeth, Seibold and Neils. The following voted against or abstained: None.
