HomeMy WebLinkAboutCity Council Resolution 1972-29277- i} VILLAGE OF PLYMOUTH If Pursuant to due call and notice thereof, a regular meeting 11of the Village Council of the Village of Plymouth, Minnesota, was t1held on the 21st day of August, 1972. The following members were 1present: Mayor Hilde, Councilmen Hunt, Spaeth, Seibold and Neils. �j fthe following members were absent: None. Y; `; 01 Councilman Neils introduced the following Resolution and 1 oved its adoption: RESOLUTION NO. 72-292 A RESOLUTION ESTABLISHING A UNIFORM POLICY RELATIVE TO THE MANNER IN WHICH ZONING ORDINANCE AMENDMENTS SHALL APPLY TO SITE PLAN PROPOSALS WHICH ARE UNDER CONSIDERATION BY THE VILLAGE AT THE TIME A ZONING ORDINANCE BECOMES EFFECTIVE NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE VILLAGE- COUNCIL OF THE VILLAGE OF PLYMOUTH that Planning Commission and Village Council consideration for approval of any proposed Site Plan requiring such approval shall'be govern- ed by the toning Ordinance regulations in effect on the date of the Planning Commission meeting at which the proposed Site Plan is approved by the 'Planni:ng Commission, provided that: 1. This policy shall not`be construed -to be a general granting of variance from zoning ordinance amendments which become effective prior to final approval and which are deemed important to health and safety and.do not require substantial change to the Site Plan. 2. The proposed Site Plan is found to be in substantial conformance with any applicable General Development Plan. 3. The proposed Site Plan is found to be in conformance with regu- lations of said effective Zoning Ordinance. 4. The proposed Site Plan is duly prosecuted in a timely manner by } the developer to final approval,by the Village Council, and con- tracts including consideration are executed within one hundred eighty (180) days in regard to public improvements, park dedication and assuring completion of landscaping and recreational facilities. �( BE IT FURTHER RESOLVED that in the event any of the foregoing provisions p; are not fully satisfied, or Site Plan approval is.denied 'with cause, the Site Plan shall be reconsidered by both Planning Commission and Village Council with respect to all Zoning Ordinance amendments enacted and published sub- sequent to the original date of consideration by the Planning Commission. i€ f The motion for the adoption of the foregoing Resolution was i1duly seconded by Councilman Seibold, and upon vote being taken thereon, the following voted in favor thereof: Mayor Hilde, Councilmen Hunt and Neils. The following voted against: Council- men Spaeth and Seibold. Whereupon the Resolution was declared duly passed and adopted. ?$STATE OF MINNESOTA COUNTY OF HENNtPhN SS.
