VILLAGE COUNCIL OF
PLYMOUTH, MINNESOTA
Pursuant to due call and notice thereof, a reqular meeting
of the Village Council of the Village of Plymouth, Minnesota, was
held on the 2nd day of October, 1972. commencing at 7:15 o'clock
p.m. in the Council Chambers of the Public Works Building, 14900
Twenty-third Avenue North, Plymouth. The following members were
present: Mayor Hilde, Councilmen Hunt, Spaeth, Seibold and Neils.
The following members were absent: None.
Councilman Hunt introduced the followin; Resolution and
imoved its adoption:
RESOLUTION NO. 72-273-A
A RESOLUTION CONFIRMING AND ADOPTING
THE ASSESSMENT FOR
COUNTY ROAD 18 FROM COUNTY ROAD 9
TO COUNTY ROAD 10 STORM SEWER
PROJECT NO. 114
WHEREAS, pursuant to due and proper notice according to law an assess-
ment hearing was held on the 2nd daffy of October, 1972 commencing at 7:15 o'clo
p.m. relating to the special assessments for County Road 18 from County Road 9
to County Road 10 Storm Sewer Project No. 114. and
WHEREAS, all persons present desiring to be heard were heard and their
objections, if any. were noted,
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF PLYMOUTH, AS FOLLOWS:
1. The Village Clerk has, with the assistance of Bonestroo, Rosene,
Anderlik b Associates, Inc., engineers heretofore selected by this
Council for such purpose, calculated the proper amounts to be
specially assessed for County Road 18 from County Road 9 to County
Road 10 Storm Sewer Project No. 114 against every assessable lot,
piece or parcel of land. in accordance with the provisions of law,
and has prepared and filed in her office tabulated statements in
duplicate showing the proper description of each and every lot,
piece or parcel of land to be specially assessed in the amount
calculated against the same.
2. Notice has been duly published as requ4red by law that this Council
would meet in special session at this time and place to pass on
the proposed assessment.
3. The proposed assessment has at all times since its filing been open
to inspection and copying by all persons interested, and an oppor-
tunity has been given to all interested persons to present their
objections, if any, to such proposed assessment, or to any item
thereof, and no objections have been filed.

This Council finds that each of the lots, pieces or parcels of land
enumerated in said proposed assessment was and is specially benefited
by the construction of County Road 18 from County Road 9 to County
Road 10 Storm Sewer Project No. 114 in the amount in said proposed
assessment set opposite the description of each such lot, piece or
parcel of land and that said amount is hereby levied and assessed.
Such proposed assessment is affirmed, adopted and confirmed, and the
Sums fixed; and the sums fixed and named in said proposed assessment
with the changes and alterations hereinabove made are affirmed,
adopted and confirmed as the proper special assessment for each of
said lots, pieces or parcels of land respectively.
6. Said assessment so affirmed, adopted and confirmed shall be certified
to by the Village Clerk and filed in her office and shall thereupon
be and constitute the special assessment for County Road 18 from
County Road 9 to County Road 10 Storm Sewer Project No. 114.
7. The amounts assessed against each lot, piece or parcel of land shall
bear interest from the date hereof until the same have been paid at
the rate of eight (8) percent per annum.
8. Such assessments shall be payable in ten (10) equal annual install-
ments payable at the first day of January in each year, beginning in
the year 1973, and continuing until all of said installments shall
have been paid, each installment to be collected with taxes collect-
able during said year by the County Auditor. To the first install-
ment shall be added interest on the entire assessment from the date
hereof of December 31, 1972. To each subsequent installment shall
be added interest for one year on all unpaid installments.
9. The Village Clerk is hereby directed to make up and file.in the
office of the County Auditor of Hennepin County a certified state-
ment of the amount of all of such unpaid assessments and the amount
which will be due thereon on the first day of January in each year.
The Motion for the adoption of the foregoing Resolution was
duly seconded by Councilman Seibold, and upon vote being taken
thereon, the following voted in favor thereof: Mayor Hilde,
Councilmen Hunt, Spaeth, Seibold and Neils. The following voted
against or abstained: None. Whereupon the Resolution was declare
duly passed and adopted.

I, the undersigned, being.the duly qualified and acting Clerk of the
Village of Plymouth, Minnesota, hereby certify that I have carefully compared
the foregoing extract of the minutes of a regular meeting of the Village
Council of said Village held October 2, 1972 with the original thereof on
file in my office, and the same is a full, true and complete transcript there-
from.
