E; Pursuant to due call and notice thereof, a special meeting of the Village

Council of the Village of Plymouth, Minnesota, was held on the 25th day of
Septembt „ 1972. The following members were present: Mayor Hilde, Councilmen
!{
Hunt, Spaeth, Seibold and Neils. The following members were absent: None.

Councilman Spaeth introduced the following Resolution and moved its
,ladoption:
i RESOLUTION NO. 72-268 (A)
WHEREAS, Bel Mar Builders, Inc., the developers of Fox Meadows, have not
completed the storm sewer construction and repairs in accordance with their
development contract, and
WHEREAS, the Village has formally notified the developer by letter dated
September 1, 1972 to initiate this work within the ten days allotted, and
i WHEREAS, this time period has passed and the developer has not commenced
( the required work,
{ -NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF PLYMOUTH as follows:
1. The following schedule is approved for this project:
j Advertisement for Bids September 28, 1972
t! Bid Opening October 12, 1972
i Award of Contract October 16, 1972
f{ Commence Work October 23, 1972
{ Completion on or about December 1. 1972

i 2. The advertisement for bids is ordered.
- The motion for the adoption of the foregoing Resolution was duly seconded
t
by Councilman Seibold, and upon vote being taken thereon, the following voted
in favor thereof: Mayor Hilde, Councilmen Hunt, Spaeth, Seibold and Neils.
�f The following voted against or abstained: None. Whereupon the Resolution was
declared duly passed and adopted.

i It, the undersigned, being the duly qualified and acting Clerk of the
Village of Plymouth, Minnesota, hereby certify that I have carefully compared

file in my office, and the same is a full, true and complete transcript there-
from.
