HomeMy WebLinkAboutCity Council Resolution 1972-262AVILLAGE OF PLYMOUTH Pursuant to due call and notice thereof, a special meeting of the Village Council of the Village of Plymouth, Minnesota, was held on the 25th day of September, 1972. The following members were present: Mayor Hilde, Councilmen Hunt, Spaeth and Seibold. The following members were absent: Councilman Neils. *r* Councilman Hunt introduced the following Resolution and moved its ';adoption: RESOLUTION NO. 72-262 (A) WHEREAS, the Playhouse Company, Inc. has completed construction of the ;majority of the streets in their development, and WHEREAS, there still remains certain repair work to be performed on said ;`streets consisting of sealing of cracks, repair and replacement of curb and ;gutter, and pea -rock seal coating, and WHEREAS, they have requested conditional acceptance of these streets to allow them to pay their street contractor for work previously performed, and WHEREAS, the Village has a Certificate of Deposit No. 2810 in the amount of $14,000.00 with the Northrestarn National Bank, and WHEREAS, the scheduling of the water and sewer construction on Playhouse Industrial Park Sewer and Water Project No. 222 in this plat suggests delay of required repairs to the street, curb and gutter, and WHEREAS, the Playhouse Company, Inc., as developer of the plat of Play- house Industrial Park, has submitted a petition for street repairs and re- construction of concrete curb and gutter and a waiver for the improvement hearing and assessment hearing for these improvements, NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF PLYMOUTH that the streets that have been completed and the concrete curb and gutter are accepted subject to the developer making repairs including sealcoating of the streets and replacement of damaged curb and gutter by August 1. 1973. In the event The Playhouse Company, Inc. does not make these repairs by August 1. 1973. the Village will proceed to make these repairs and assess the costs to the developer in accordance with the petition and waiver of bearing submitted by The Playhouse Company. Inc., dated September 21, 1972. In addition, the Village will retain the Certificate of Deposit No. 2810 in the amount of $14,000.00 with the Northwestern National Bank to cover costs of these repairs and of the construction of Parkview Lane (in line with Village street pattern Ranchview Lane) in the area south of 32nd Avenue and any other incomplete work. The amount of this bond will be re-evaluated upon completion of these requirement. The motion for the adoption of the foregoing Resolution was duly seconded by Councilman Seibold, and upon vote being taken thereon, the following voted in favor thereof: Mayor Hilde, Councilmen Hunt, Spaeth and Seibold.
