HomeMy WebLinkAboutCity Council Resolution 1972-261A.7— VILLAGE OF PLYMOUTH Pursuant to due call and notice thereof, a special meeting of Ithe Village Council of the Village of Plymouth, Minnesota, was hel ion the 25th day of September, 1972. The following members were lipresent: Mayor Hilde, Councilmen Hunt, Spaeth and Seibold. The following members were absent: Councilman Neils. Councilman Hunt introduced the following Resolution and ved its adoption: RESOLUTION NO. 72-261 (A) WHEREAS, a Subdivision Variance has been requested by Metram Properties, Inc., owner of property located on the West side of Lancaster Lane in Section 13, and WHEREAS, the Village Council has now determined that the subdivision of said land into two parcels, one containing less than five (5) acres would not interfere with the purposes of the Subdivision Regulations of the Village of Plymouth and that a refusal to permit such subdivision would create an un- necessary hardship on said owner, NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE 'VILLAGE COUNCIL OF THE VILLAGE OF PLYMOUTH as follows: 1. Compliance with the provisions of Section 462.358, Subdivision 4, Minnesota Statutes and Chapter VII'of the Village Code relating to conveyances of unplatted land containing an area of less than five (5) acres is hereby waived with respect to the following described parcels: PARCEL -r#-- 584,958 square feet 13.4 acres ± Lot 1, Block 3, PLYMOUTH PLAZA 4TH ADDITION, EXCEPT that part of Lot I described as beginning at the most northeasterly cor- ner of said Lot 1; thence southerly along the east line of said Lot 1, Block 3 for a distance of .158.63 feet to a point of cur- vature; thence continuing south along said east line for a dis- tance of 290.00 feet; thence deflecting to the right at an angle of 90 degrees 00 minutes 00 seconds for a distance.of 300.00 feet; thence deflectingto the right at an angle of 76 degrees 99 minutes 00 seconds to the north tine of said Lot 1, Block 3; thence easterly along said north line to the point of beginning. Also EXCEPT that part of said Lot l lying southerly of the fol- lowing described liner Commencing at the southwesterly corner of said Lot 1; thence northerly along the westerly line of said Lot l a distance of 567.33'feet to the actual point of beginning of the Tine to be described; thence easterly deflecting to the right 98 degrees 27 minutes 35 seconds a distance of 298.33 feet; `thence easterly deflecting, to the right 21 degrees 22 minutes OO seconds a distance of 178.,90 feet,; thence easterly to a point in the easterly line of said Lot 1, distant 582.16 feet northerly, measured along said easterly line, from the southeasterly corner of said Lot l and there terminating. �i PARCEL B 217,789 square feet ii 4.75 acres That part of Lot 1. Block 3, PLYMOUTH PLAZA 4TH ADDITION, de- scribed as follows: Beginning at the southwesterly corner of said Lot 1; thence northerly along the westerly line of said Lot 1 a distance of 567.33 feet; thence easterly deflecting to the right 98 degrees 27 minutes 35 seconds a distance of 298.33 feet; thence easterly deflecting to the right 21 degrees 22 minutes 00 seconds a distance of 178.9 feet; theme southerly deflecting to the right 78 degrees 26 minutes OO,s,aconds a dis- tance of 290.70 feet; thence southerly 170 feet to a point in the southerly line of said Lot 1, distant 462.77 feet easterly, measured along said southerly line, from the point of beginning; thence westerly along said southerly line 462.77 feet to the point of beginning. 2. The Village Clerk is directed to prepare a certified copy of this Resolution for recording purposes. The motion for the adoption of the foregoing Resolution was duly seconded by Councilman Seibold, and upon vote being taken thereon, the following voted in favor thereof: Mayor Hilde, Councilmen Hunt, Spaeth and Seibold.
