HomeMy WebLinkAboutCity Council Resolution 1972-257AVILLAGE OF P-L-vM'OUTH Pursuant to due call and notice thereof, a special meeting of ;'the Village Council of the Village of Plymouth, Minnesota, was .`held on the 25th day of September. 1972. The following members ,-were present: Mayor Hilde, Councilmen Hunt. Spaeth and Seibold. ,,The following members were absent: Councilman Neils. Councilman Spaeth introduced the following Resolution and ;moved its adoption: i RESOLUTION NO. 72-257 (A) A RESOLUTION WAIVING THE REQUIREMENT OF SECTION 462.358, SUBDIVISION 4. MINNESOTA STATUTES AND SECTION 9.02 OF CHAPTER VII OF THE VILLAGE CODE RELATIVE TO CONVEYANCES BY METES AND BOUNDS OF PARCELS OF LAND CONTAINING LESS THAN FIVE ACRES WHEREAS, Edward A. Nelson has requested that existing Lots 1, 2 and 3 of Sunset Acres Addition be further subdivided, and WHEREAS, the Village Council has now determined that the subdivision of said land into parcels which would contain less than five (5) acres would not interfere with the purposes of the Subdivision Regulations of the Village of Plymouth and that a refusal to permit such subdivision would create an un.'- necessary n-necessary hardship on such owner, NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF PLYMOUTH AS FOLLOWS: 1. Compliance with the provisions of Section 462.358, Subdivision 4,` Minnesota Statutes and Section 9.02 of Chapter VII of the Village Code relating to conveyances by metes and bounds of parcels of land containing an area of less than five (5) acres is hereby waived with respect to the following described parcels: PARCEL A The Westerly 132.0 feet of Lot l and that part of the Westerly 132.0 feet of Lot 2 lying Northerly of a line drawn from a point on the Westerly fine of said Lot 2 distant 70.01 feet South of the Northwest corner of said lot 2 to a point on the Easterly line of said Lot 2 distant 68.75 feet South of the Northeast corner of said Lot 2, Block 3, Sunset Acres Addition. Contain- ing 0.6 acres, more.or less. PARCEL B That part of Lot 1 lying Easterly of the Westerly 132.0 feet, except the Easterly 10.0 feet, and that part of Lot 2 lying Easterly of the Westerly 132.0 feet and lying Northerly of a line drawn from a point on the Westerly line of said Lot 2 distant 70.01 feet South of the Northwest corner to a point on the Easterly line of said Lot 2 distant 68.75 feet South of the Northeast corner of said Lot 2, except the Easterly 10 feet, all in Block 3, Sunset Acres PARCEL C The Westerly 132.0 feet of Lot 3 and that part of the Westerly 132.0 feet of Lot 2 lying Southerly of a line drawn from a point on Westerly line of said Lot 2 dis- tant 70.02 feet North of the Southwest corner of said Lot 2 to a point on the Easterly line of said Lot 2 distant 68.75 feet North of the Southeast -corner of said Lot 2, all in Block 3. Ij PARCEL D ii That part of Lot 3 lying Easterly of the Westerly 132.0 Ir feet, except the Easterly 10.0 .feet, and that part of Lot 2 lying Easterly of the Westerly 132.0 feet and lying f Southerly of a line drawn from a point on the Westerly line of said Lot distant 70.02 feet North of the South- west corner of said Lot 2 to a point on the Easterly line j! of said Lot 2 distant 68.75 feet North of the Southeast corner of said Lot 2, except the Easterly 10.0 feet, all in Block 3, Sunset Acres. 2. The Village Clerk is directed to prepare a certified copy of this Resolution and insert legal descriptions for the four parcels for recording purposes. The motion for the adoption of the foregoing Resolution was luly seconded by Councilman Seibold, and upon vote being taken thereon, the following voted in favor thereof: Mayor Hilde, Coun- :ilmen Hunt, Spaeth and Seibold. The following voted against or abstained: None. Whereupon the Resolution was declared duly Sassed and adopted. *** STATE OF MINNESOTA COUNTY OF HENNEPIN ; SS. VILLAGE OF PLYMOUTH) b, the undersigned, being the duly qualified and acting Clerk of the Village of `Plymouth. Minnesota, hereby certify that I have carefully compared the foregoing extract of the minutes of a special meeting of the Village Coun- cil of said Village held on September 25, 1972, with the original thereof on file in may office, and the same is a full, true and complete transcript there- from.
