HomeMy WebLinkAboutCity Council Resolution 1972-255AVILLAGE:.OF PLYMOUTH Pursuant to due call and notice thereof, a special meeting of Ithe Village Council of the Village of Plymouth, Minnesota, was i (held on the 25th day of September, 1972. The following members twere present: Mayor Hilde, Councilmen Hunt, Spaeth and Seibold. jThe following members were absent: Councilman Neils. I Councilman Spaeth introduced the following Resolution and moved its adoption: RESOLUTION NO. 72-255 (A) WHEREAS, Magna Realty on behalf of the owner, Northern Preferred Company, has requested that existing parcels 4220 and 4246 of Lot 1, Block D, Plymouth Orchards be further subdivided, and WHEREAS, the Village Council has now determined that the subdivision of said land into four parcels, all of which would contain less than five (5) acres, would not interfere with the purposes of the Subdivision Regulations of the Village of Plymouth and that a refusal to permit such subdivision would create ,an unnecessary hardship on such owner, NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF PLYMOUTH as follows: 1. Compliance with the provisions of Section 462.358, Subdivision 4, Minnesota Statutes and Section 9.02 of Chapter VII of the Village Code relating to conveyances by metes and bounds of parcels of land containing an area of less than five (5) acres is hereby waived with respect to the following described parcels: PARCEL 1 The South 106 feet of Lot 1, Block D, Plymouth Orchards according to the plat thereof on file and of record in the office of Register of Deeds, Hennepin County, Minnesota. Subject to easement for street purposes over the Easterly 33 feet thereof. Subject to any easements of record. PARCEL 2 The North 106 feet of the South 212 feet of Lot 1, Block D,, Plymouth Orchards, according to the plat thereof on file and of record in the office of Register of Deeds, Hennepin County, Minnesota. Subject to easement for street purposes over the Easterly 33 feet thereof. Subject to any easements of record. PARCEL 3 C' The Westerly 142.5 feet of that part of Lot 1, Block D. Plymouth Orchards. lying North of the South 312 feet of said Lot 1. according to the plat of said Plymouth Orchards on file and of record .in the office of the Register of Deeds, Hennepin County, Minnesota. Subject to any ease- ments of record. PARCEL 4 That ;part of Lot 1 Block 'D, Plymouth Orchards. lying North of the South 312 feet and lying East of the Westerly 142.5 feet, according to the plat of said Plymouth Orchards on file and of record in the office of the Register of Deeds, Hen nep%, County, Minnesota. Subject to easement for street purposes over the Easterly 33 feet thereof. Subject to any easements of record. {i_ 2. The Village Clerk is directed to prepare a certified copy of this Resolution for recording purposes. 9 Ti,! motion for the adoption of the foregoing Resolution was duly seconded by Councilman Seibold, and upon vote being taken { }� thereon, the following voted in favor thereof: Mayor Hild e, Councilmen Hunt, Spaeth and Seibold. The following voted against or abstained: None. Whereupon the Resolution was declared duly 11passed and adopted. TATE OF MINNESOTA OUNTY OF HENNEPIN SS.
