{r{ Pursuant to due call and notice thereof, a special meeting of

;the Village Council of the Village of Plymouth, Minnesota, was held
,on the 11th day of September, 1972. The following members were
'present: Mayor Hilde, Councilmen Hunt, Spaeth, Seibold and Neils.
?he following members were absent: None.

Councilman Spaeth introduced the following Resolution and
;moved its adoption:
RESOLUTION NO. 72-248 (A)
WHEREAS, a Subdivision Variance has been requested by J. Bernard Heller,
?owner of property located at the East end of 28th Avenue North on the West side
:sof Medicine Lake, and
WHEREAS, the Village Council has now determined that the subdivision of
:said land into two parcels, each containing less than five (5) acres would not
,interfere with the purposes of the Subdivision Regulations of the Village of
;!Plymouth and that a refusal to permit such subdivision would create an un -
!necessary hardship on said owner,
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE VILLAGE COUNCIL OF THE
IjVILLAGE OF PLYMOUTH that compliance with the provisions of Section 462.358,
':'Subdivision 4. Minnesota Statutes and Chapter VII of the Village Code relating
,ilto conveyances of unplatted land containing an area of less than five (5) acres
!is hereby waived with respect to the following described parcels subject to the
;;condition that the Building Department not approve any building plans rith base-
ment floor elevations of less than 890.2 feet:
PARCEL 1
(73,633 square feet *)
That part of Track H lying 'asterly of a line parallel with and 100
feet Easterly from the West line of said Tract H.except that part
lying East of the Westerly line of Tract L. Registered Land Survey
No. 237. extended Northerly to the shore of Medicine Lake;
Tract I except the West 140 feet thereof;
Tract J except the West 84 feet thereof;
Tract L except that part of the Easterly 23.5 feet thereof as measured
along the North and South lines of said Tract L lying North of a line
extended East drawn from a point in the West line of said tract 185.82
feet South from the Northwest corner of said tract and parallel with
the South line thereof, and also except thatpart of the Easterly 1/2
of said Tract L as measured along the North and South lines of said
Tract L lying South of said tine extended East drawn from a point in
the West line of said tract 185.82 feet South from the Northwest cor-
ner of said tract and parallel with the South line thereof;
The Westerly 1/2 of Tract M, as measures along the North and South
lines of said Tract M;
All in Registered Land Survey No. 237. Files of the Register of
Titles, County of Hennepin, Minnesota.

All of Tract K;
That part of the Easterly 1/2 of Tract L as measured along the
North and South lines of said Tract L lying South of a line ex-
tended East drawn from a point in the West line of said tract
185.82 feet South from the Northwest corner of said tract and
parallel with the South line thereof;
The Easterly 1/2 of Tract M, as measured along the North and
South line of said Tract M;
All in Registered Land Survey No. 237, Files of the Register of
Titles, County of Hennepin, Minnesota;
That part of Government Lot 8, Section 23, Township 118 North,
Range 22 West of the Fifth Principal Meridian, described as follows:
Beginning at a point 1019.3 feet East of a point 1270.66 feet
North of the Southwest corner of said Government Lot 8, said
point of beginning being in the Easterly line of West Point Street
as dedicated in the plat of Bolduc's Medicine Lake Park. pro-
duced Northerly; thence Northerly along the Easterly line of
said West Point Street produced a distance of 50 feet; thence
East parallel with the South line of said Section 23 a distance
of 10,2.15 feet more or less to the average high water line of
Medicine Lake; thence Southerly along said water line to its
intersection with a line drawn East from point of beginning;
thence West parallel with the South line of said section a dis-
tance of 182.15 feet more or less to the point of beginning;
All subject to easements and restrictions of record, if any.
The motion for the adoption of the foregoing Resolution was
uly seconded by Councilman Hunt, and upon vote being taken thereon
he following voted in favor thereof: Mayor Hilde, Councilmen
unt, Spaeth, Seibold and Neils. The following voted against or
bstained: None. Whereupon the Resolution was declared duly passel
nd adopted.

I, the undersigned, being the duly qualified and acting Clerk of the
Village of Plymouth, Minnesota, hereby certify that I have carefully compared
the foregoing extract of the minutes of a special meeting of the Village
Council of said Village held September 11, 1972 with the original thereof on
file in my office, and the wane is a full, true and complete transcript there-
from.
