Pursuant to due call and notice thereof, a special meeting of the Village
f Council of the Village of Plymouth, Minnesota, was held on the 11th day of
!'September, 1972. The following members were present: Mayor Hilde, Councilmen
!;Hunt, Spaeth, Seibold and Neils. The following members were absent: None.

Councilman Hunt introduced the following Resolution and moved its
adoption:
RESOLUTION NO. 72-243 (A)
WHEREAS, Ecklund and Swedlund Construction Company have agreed to donate
!certain lands for public park purposes, which lands are described on Exhibit "A"
''attached hereto, and
WHEREAS, the acceptance of said land by the Village is deemed to be in t>le
'lpublic interest,
NOW, THEREFORE. BE IT HEREBY RESOLVED BY THE VILLAGE COUNCIL OF THE
!!VILLAGE OF PLYMOUTH that the Village accept the land described on Exhibit "A"
14ttached hereto for park purposes from Ecklund and Swediund Construction
11Company, and
FURTHER, that this dedication of said land for park purposes is deemed
{iby this Council to meet the requirements of the Village with respect to the
,!amount of land to be dedicated for public park purposes for all the land with
Ithe Imperial Hills 3rd and proposed Imperial Hills South additions as presently
5oned as single family use provided all said land is developed in single family
,,residential units.
The motion for the adoption of the foregoing Resolution was duly seconded
Councilman Spaeth, and upon vote being taken thereon, the following voted in
vor thereof: Mayor Hilde, Councilmen Hunt, Spaeth, Seibold and Neils. The
Mowing voted against or abstained: None. Whereupon the Resolution was de-
ared duly passed and adopted.

SU3jrCT- IMPERIAL HILLS PARK DEDICATION
The Council will recall the problems we have previously encountered in seeking
to come to a resolution of this matter.
Very briefly, to review, Mr. Swedlund contributed $1,775 to the Village park
fund with the approval of the Imperial Hills Addition (71 acres @ $25/acre).
The Imperial Hills 2nd Addition was a re -platting of a part of the original
Imperial Hills Addition, and no contribution was made. With the approval of
the Imperial Hills 4th Addition, the park fund received another $3,157.50
(42.1 acres @ $75/acre). The Imperial Hills 3rd Addition, however, was platted
and the development contract executed without specific reference to park land
or cash in lieu thereof. While there were discussions regarding the dedication
of the land generally covered by the present propos.., these discussions failed
' to result in a concrete understanding. As a result ,ae situation remained
unresolved until Howard Hunt raised the question when Mr. Swedlund requested
that his bond be reduced.
Since that date -- September 13, 1971 -- this matter has been explored thor-
oughly by the staff. Numerous meetings between Mr. Swedlund, the Mayor and
the staff have been held to resolve the problem. We believe the following is
a reasonable solution, which benefits Village residents residing in the
Imperial Hills area and the public generally.
The understanding we have reached, and which we recommend for your approval,
is as follows:
1. Ecklund and Swedlund deed to the Village the land indicated on the
attached map for park purposes.
2. The Village accepts the park land in fulfillment of the park dedication
requirements for the Imperial Hills 3rd Addition, as well as the
adjacent undeveloped land to the west,: generally referred to as_.
Imperial Hills South, subject to the understanding that the Imperial
' Hills South land be.developed in single-family detached residential
units.Should future development occur which deviates from single-
family residential construction, then, and in that case, additional
park dedication requirements would be required for the additional
density beyond that,contemplated,in the proposed, Imperial Hills .
